subdivision approval, P.U.D. approval or request for a building <br />permit for a new structure within the Subject Property which is <br />not an accessory use to an existing use within such property. <br />(c) The City agrees not to charge any Water Resource <br />Fee in connection with the non-residential development of the <br />Subject Property so long as development is consistent with the <br />General Development Plan approved by the City. <br />(d) The City acknowledges that such actions by Annexor <br />satisfy the requirements of the City Code and policy regarding <br />the dedication of water rights. <br />11. Public Land Dedication. At the time of the first <br />subdivision of the Subject Property, Annexor agrees to meet the <br />requirements of Section 16.16.060 of the Louisville Municipal <br />Code, as it may hereafter be amended, regarding the dedication of <br />public lands. In the event that only a portion of the Subject <br />Property is subdivided, the required dedication shall apply only <br />to such portion of the Subject Property. <br />12. Miscellaneous. Annexor and the City further agree as <br />follows• <br />(a) The existing residential and agricultural use of <br />the Subject Property may continue until the time of development <br />of the Subject Property. For purposes of this paragraph, "devel- <br />opment" shall mean the earliest of subdivision approval, P.U.D. <br />approval or request for a building permit for a new structure on <br />the Subject Property which is not an accessory use to an existing <br />structure on the Subject Property.
