HWY 42 is an important land use <br />issue and should be reviewed by the Planning Commission. He reminded the <br />others that the Louisville Revitalization Commission (LRC) is not a decision <br />making board. They provide recommendations to City Council and then Council <br />makes the decision. What needs to be kept in mind is the involvement of the <br />Planning Commission with specific land use issues. <br /> <br />Pritchard stated the LRC does have the same open meeting policy and so the <br />process through LRC has been available to the public. He does not feel that the <br />process followed by LRC has been flawed. <br /> <br />Tengler stated he had no comments. <br /> <br />Sheets requested that staff take this discussion and the concerns of the Planning <br />Commission to the City Manager and the City Attorney. <br /> <br />Russell stated the Commission needed to continue this concern before them <br />because the process is still in the early stages and the Commission has the <br />opportunity to keep the public involved. <br /> <br />Regular Business - Public Hearing Items: <br />~ Resolution No. 03, Series 2009 - A resolution recommending <br />approval of a special review use (SRU) to allow for the addition of a <br />patio seating area at the entrance of an existing restaurant. 585 E. <br />South Boulder Road (Village Square Shopping Center) Case No. 09- <br />003-U R. <br />. Case Manager: Sean McCartney, Principal Planner <br /> <br />Public Notice Certification: <br />Published the Camera on March 29, 2009. Posted in City Hall, Public Library, <br />Recreation Center and Courts and Police Building and mailed to surrounding <br />property owners on March 27,2009. <br /> <br />Conflict of Interest and Disclosure: None heard. <br /> <br />Staff Report of Facts and Issues: <br />McCartney noted an additional letter of support had been received in the <br />Planning office since the packet had been distributed. A copy of the letter was <br />provided to each Commissioner, posted on wall in Council Chambers and copies <br />provided to the applicant and members of the audience. <br /> <br />Sheets moved and Russell seconded a motion to enter the letter from Walgreens <br />into the public record. Motion passed unanimously by voice vote. <br /> <br />McCartney provided the following summary of the project: <br />. Request is a special review use (SRU) to allow an outside patio dining <br />area. <br />. Louisville Municipal Code requires that all outdoor dining services be <br />approved through the SRU process no matter the approved zoning is for <br />the subject property. <br />
