around and below the mail ballot drop-off box, approximately a 4.5-foot by 4.5-foot square, <br />are referred to as the "Premises." <br />b. Installation and Maintenance. The Clerk will install a mail ballot drop-off box <br />similar to one pictured in Exhibit B at the location on the Property identified in Exhibit A. <br />The Clerk is authorized to install a mail ballot drop-off box at the Property on or by December <br />31, 2021. This may also include installing a cement pad to affix the mail ballot drop-off box if <br />necessary to secure it. The Clerk is responsible for the cost of installing the mail ballot drop- <br />off box. During all times that the mail ballot drop-off box is installed on the Premises, the <br />Clerk shall maintain the Premises in good repair at the Clerk's expense. During all times that <br />the mail ballot drop-off box is installed on the Premises, the City shall ensure that the <br />Premises are adequately lit. <br />c. Duration of Use. The mail ballot drop-off box is permanently installed on the <br />Premises. However, the mail ballot drop-off box will only be open to receive mail ballots <br />from the time ballots are mailed by the Clerk until Election Day during a general election, a <br />primary election, a coordinated election and any special election. During the period in which <br />mail ballots may be dropped off, the mail ballot drop-off box will be available to voters 24 <br />hours a day. <br />d. Access to Premises. The Clerk, as well as the Clerk's agents and contractors, <br />shall have the right of ingress and egress in, to, through, over, and across the Property for <br />purposes of installing, replacing, repairing and maintaining the Premises and for collecting <br />ballots from the mail ballot drop-off box during an election. <br />e. Schedule for Access. The Parties may establish a schedule before each election <br />setting forth the dates and times that the Clerk's staff will access the mail ballot drop-off box <br />to collect ballots. <br />2. Use of the City's Video Security Surveillance Recording System. The City has <br />permanently installed a video security surveillance recording system on the Property that <br />includes a camera and a recording system that is in active use and that records the Premises. <br />Recording of a mail ballot drop-off box when it is being used to receive ballots during an <br />election is required by Colorado law and regulation. The City will permit the Clerk to have <br />access to the video security surveillance recording system as well as the video data from the time <br />ballots are mailed by the Clerk until Election Day during a general election, primary election, a <br />coordinated election, or any special election for the sole purpose of compliance with Colorado <br />election law and regulations. The Clerk will be responsible for obtaining and retaining the video <br />data during this period. The City will ensure that the video security surveillance recording <br />system shall remain in place and be maintained in good repair. <br />3. Use of the City's Internet Network. The City shall permit the Clerk to utilize the <br />City's internet network by providing an IP address for the sole purpose of accessing recorded <br />surveillance footage and storing it on a Boulder County -maintained server. The City will also <br />provide an Internet Network contact for the Clerk's technical support representatives to work <br />with.
