on the issue of the compact cars. I not sure I appreciate them strongly enough to force a major <br />revision of the site plan, although I think they are technically correct. I think this is a good <br />plan and an attractive plan. <br />Commissioner McAvinew - I would also like to eliminate condition number one. <br />Motion made to accept Resolution # 5A, Series 1995, a Resolution approving a Final PUD <br />Development Plan for the Homestead Village Efficiencies Extended stay Motel with the <br />following conditions: Strike condition 1 as written. Renumber condition 2 to condition 1 and <br />change it to read "The completion of the extension of Dahlia Street will be required prior to <br />C.O. to provide two accesses to this property etcetera". Change condition 3 to condition 2. <br />Renumber conditions 4 to condition 3. Renumber condition 5 to condition 4. New condition <br />5 - A drainage plan shall be presented which is in substantial compliance with City standards; <br />and the applicant shall meet with the City engineering staff prior to final submission. 6 - The <br />location of all lighting fixtures should be shown on the elevations and a photometric lighting <br />plan shall be provided. 7 - An agreement with the Colorado Department of Transportation <br />regarding placement and maintenance of landscape materials in US 36 right-of-way shall be <br />finalize prior to building permits. 8 - Additional evergreen trees shall be included in the <br />landscaped areas adjacent to Dillon Road. Motion seconded. <br />Roll Call Vote: Jeffrey Lipton - Yes; Russ VanNostrand - Yes; Rex Renfrew - Yes; Tom <br />McAvinew - Yes; Bill Boulet - Yes. Motion passed by a vote of 5 - 0. <br />E. Massage Therapy Ordinance: <br />Staff Presentation - Peter Kernkamp gave the staff report. Staff feels that use group number <br />24, which is personal services including but not limited to Barber Shops and Beauty Shops, <br />Dry Cleaning Outlets, Self Service Laundries, Shoe Repair Shops and similar activities would <br />be the use group that would most closely represent what a massage therapist would be most <br />similar to. Staff has attached a draft ordinance to your packets. <br />P/C Questions to Staff <br />Q. Are we anticipating a personal service massage therapist facility? <br />A. We have had a number of request and there has been some confusion. We have <br />already made an administrative interpretation of the ordinance, essentially to this <br />effect, that we have been operating under. <br />Q. The massage therapist being included in here would be more inconsistent rather <br />than in with the massage parlor statutes? <br />A. No. What triggered the need for this clarification is that our ordinance currently <br />only talks about massage parlors. Message therapist is treated in both State <br />Statutes and in our licensing requirements as something entirely separate and <br />different. So it was inappropriate to consider a massage therapist the same as a <br />massage parlor. <br />27 <br />
