SUBJECT: RESOLUTION NO. 47, SERIES 2021 <br />DATE: JULY 20, 2021 PAGE 8 OF 13 <br />3. Whether the proposed subdivision will promote the purposes set forth in section <br />16.04.020 of this Code and comply with the standards set forth in chapter 16.16 of <br />this Code and this title. <br />The Final Plat promotes the purposes set forth in the LMC, including the assurance that <br />public services are available, that character and economic stability of the city is protected, <br />that there is safe and efficient circulation of traffic, pedestrians and bikeways, and provides <br />appropriate regulation of the use of land in the city. <br />The Filing 1 subdivision and associated agreement set forth the expectations for public <br />land dedication through dedication of the perimeter outlots and the remainder through <br />payments -in -lieu. The agreement allowed deferral of payments for Parcels 1 and 2 until <br />any portion of them is developed. With approval of this subdivision, the applicant will be <br />providing the remainder of the entire payment -in -lieu for all of Parcel 1, leaving only the <br />payment for Parcel 2 (Games) remaining. A subdivision agreement is provided as an <br />attachment reflecting these terms. <br />A minor condition of approval is included to modify Note 9 on the plat to clarify the purpose <br />of a proposed easement. <br />PUBLIC COMMENTS: <br />Public Comments received to date are included as an attachment. <br />PLANNING COMMISSION RECOMMENDATION: <br />The Planning Commission held a public hearing on the request on July 8, 2021 and voted <br />4-0 to recommend approval of the request. The minutes are included as an attachment. <br />STAFF RECOMMENDATION: <br />Staff recommends approval of Resolution No. 47, Series 2021 approving a final planned <br />unit development to allow construction of a 100,000 sf industrial building, and associated <br />site improvements, and a final plat to create 1 parcels and 4 lots, with the following <br />condition: <br />1. Prior to recordation of the plat, the applicant shall amend Note 9 to remove the word <br />"Temporary" and replace with the word "Maintenance". <br />ATTACHMENTS: <br />1.
