City Council <br />Meeting Minutes <br />July 20, 2021 <br />Page 3 of 9 <br />Mayor Stolzmann asked how the setback was determined in the initial general <br />development plan (GDP). Ritchie stated in the GDP there is a 55-foot building setback <br />and an additional 30-foot parking setback for the properties fronting 96th Street. <br />Mayor Stolzmann noted the property has an irregular shape that could cause future <br />issues. She asked if there has been discussion about this. Ritchie stated that the north - <br />south drive access is set and staff feels this will dictate much of the future development <br />and access and staff doesn't feel it is constraining to future development. <br />Mayor Stolzmann suggested a note or finding that this lot is being approved as it is and <br />that the adjacent lot will still need to meet all land use requirements regardless of its <br />shape. Ritchie stated there could be a finding that the size and orientation of Parcel 1A is <br />not justification for a waiver for future development. She also noted that adding this <br />finding does not bind a future Council to that decision but it would clarify Council's intent. <br />Mayor Pro Tem Maloney asked how the traffic study was done. Ritchie stated two studies <br />were done and they cross referenced the surrounding properties to address traffic from <br />various properties. Ritchie stated staff reviewed the studies and is comfortable with the <br />methodology the traffic engineers used. <br />Motion: Mayor Pro Tem Maloney moved to approve Resolution No. 47, Series 2021; <br />seconded by Councilmember Lipton. <br />Councilmember Lipton asked that the condition in the staff report be included in the <br />motion. Mayor Pro Tem Maloney agreed to add it. <br />Mayor Stolzmann offered a friendly amendment to include a finding that the size and <br />orientation of Lot 1 a would not be the sole justification for a waiver. She noted the lot is an <br />unusual shape and she feels that their choice to create this oddly shaped lot should not <br />require the City to give waivers for development on the adjacent property. <br />Mayor Pro Tem Maloney and Councilmember Lipton agreed to the friendly amendment. <br />Mayor Stolzmann closed the public hearing. <br />Vote: Motion passed by unanimous roll call vote. <br />DISCUSSION/DIRECTION — DARK SKIES COMPLIANT LIGHTING POLICY <br />Principal Planner Ritchie stated this item is a part of the 2021 City Council work plan. The <br />goals are to minimize adverse offsite impacts of lighting, such as light trespass and glare; <br />to protect natural environment and wildlife; to conserve energy and resources; to reduce <br />light pollution, and to improve nighttime environment for astronomy. <br />
