The development design standards and <br />guidelines contained in the Handbook may be amended from time to time in the manner set <br />forth in Chapter 17.44. The City Council may, in its discretion, waive or modify any <br />requirements of the Handbook in the planned unit development plan approved hereunder in <br />accordance with the criteria set forth in Section 17.28.110. All applicants for commercial <br />development or other types of work in Downtown Louisville shall be advised as to the <br />existence of the Handbook and a copy thereof shall be made available to such applicants. <br /> <br /> Section 7. Chapter 15.04 of the Louisville Municipal Code is hereby amended by the <br />addition of a new Section 15.04.140, to read as follows (words added are underlined): <br /> <br /> 15.04.140 Design Handbook for Downtown Louisville to Apply. <br /> Any addition, remodeling, relocation, construction, or other improvement within <br /> Downtown Louisville and requiring a building permit, sign permit, or any other permit from <br /> the City shall comply with all requirements of Design Handbook for Downtown Louisville, <br /> as adopted and amended from time to time. <br /> Section 8. Chapter 17.16 of the Louisville Municipal Code is hereby amended by the <br />addition of a new Section 17.16.270, to read as follows (words added are underlined): <br /> <br /> 17.16.270 Design Handbook for Downtown Louisville to Apply. <br /> Any addition, remodeling, relocation, construction, or other improvement within <br /> Downtown Louisville and requiring a building permit, sign permit, or any other permit from <br /> the City shall comply with all requirements of Design Handbook for Downtown Louisville, <br /> as adopted and amended from time to time. <br /> Section 9. Any person who violates any provision of this Ordinance shall be punished <br />by a fine of not more than $1,000 or by imprisonment not to exceed one (1) year or both such fine <br />and imprisonment. Each day during any portion of which any violation of any provision of this <br />ordinance is committed, continued, or permitted by any such person shall be a separate offense. <br /> <br /> Section 10. If any portion of this ordinance is held to be invalid for any reason, such <br />decision shall not affect the validity of the remaining portions of this ordinance. The City Council <br />hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact <br />that any one part be declared invalid. <br /> <br /> Section 11. The repeal or modification of any provision of the Municipal Code of the <br />City of Louisville by this ordinance shall not release, extinguish, alter, modify, or change in whole <br />or in part any penalty, forfeiture, or liability, either civil or criminal, which shall have been incurred <br />under such provision, and each provision shall be treated and held as still remaining in force for the <br />purpose of sustaining any and all proper actions, suits, proceedings, and prosecutions for the <br />enforcement of the penalty, forfeiture, or liability, as well as for the purpose of sustaining any <br />judgment, decree, or order which can or may be rendered, entered, or made in such actions, suits, <br />proceedings, or prosecutions. <br /> <br /> <br />
