City Council <br />Meeting Minutes <br />September 21, 2021 <br />Page 6 of 11 <br />Councilmember Fahey stated this proposal surpasses our requirements in many ways. <br />She supports the plan and conditions as proposed tonight. She agreed it is not perfect but <br />is very good and she supports it. <br />Mayor Stolzmann stated she does not feel this proposal is above what is required by the <br />code. She noted the request to build above 2.5M square feet surpasses what is currently <br />allowed on the site, and she feels the open space dedication may meet the minimum <br />dedication but the code allows the Council to require more to protect view sheds and <br />wildlife corridors and she feels the 93 acres is not a sufficient dedication. She feels the <br />proposed density on the site is not in line with the rural character. <br />Mayor Stolzmann stated she would support Councilmember Leh's request to reduce the <br />density on the site. <br />She added she feels the traffic impacts will be much greater than shown in the traffic <br />study and she feels the intersection of Campus Drive and 96t" street is going to back up <br />significantly at peak hours. She stated she has some reservations that the industrial <br />design guidelines will be used for buildings adjacent the street. <br />VOTE on the substitute motion. Motion failed 5-2 with Councilmember Leh and Mayor <br />Stolzmann voting yes. <br />Councilmember Leh offered a friendly amendment to change Condition #2 allow a <br />maximum of 2,950,101 square feet of development on the site. Councilmember Lipton did <br />not accept the friendly amendment. <br />VOTE on the original motion. Motion passed 4-3 with Councilmembers Leh and Brown <br />and Mayor Stolzmann voting no. <br />ORDINANCE NO. 1813, SERIES 2021 — AN ORDINANCE AMENDING TITLE 17.16.170 <br />OF THE LOUISVILLE MUNICIPAL CODE CONCERNING SWIMMING POOLS AND <br />SPAS — 2nd READING, PUBLIC HEARING (advertised Daily Camera 8/22/21) <br />Mayor Stolzmann introduced the item and asked if there were any disclosures; seeing <br />none she opened the public hearing. <br />Interim Planning Director Ritchie stated these proposed amendments to the City's zoning <br />code relate to fence and gate standards for swimming pools and to would clarify <br />development standards. The code currently includes standards from 1973 that are also <br />repeated by requirements in the adopted building code. <br />The proposed amendments are intended to: 1) remove standards in Title 17, Zoning, that <br />are also included in Title 15, Buildings and Construction; and 2) clarify that accessory use <br />setbacks apply to swimming pools and spas.
