Staff recommends approval. <br />Public Comments — None <br />Public Comments — None <br />MOTION: Mayor Pro Tern Maloney moved to approve Ordinance No. 1813; seconded by <br />Councilmember Dickinson. <br />VOTE: Motion passed by unanimous roll call vote. <br />ORDINANCE NO. 1814, SERIES 2021 — AN ORDINANCE AMENDING THE CITY'S <br />DISPOSABLE BAG TAX TO PROVIDE A CREDIT IN THE AMOUNT OF THE STATE <br />CARRYOUT BAG FEE TO BE COLLECTED BY RETAILERS AND TO OTHERWISE <br />ALIGN WITH THE STATE CARRYOUT BAG FEE IN ORDER TO REDUCE THE <br />ADMINISTRATIVE BURDEN ON THE CITY'S RETAILERS — 2nd READING, PUBLIC <br />HEARING (advertised Daily Camera 9/12/21) <br />Mayor Stolzmann introduced the item and asked or any disclosures, seeing none she <br />opened the public hearing. <br />Sustainability Coordinator Baum stated Louisville voters approved a ballot issue in 2020 <br />which applies a $0.25 tax on every paper and plastic bag provided to customers by all <br />Louisville retailers. The bag tax will go into effect January 1, 2022. <br />The proposed ordinance will align the City's regulations with new State regulations by <br />providing a credit to stores in the amount of the required state fee. In 2022, $0.25 tax per <br />bag would be collected by all City retailers, with $0.15 of that tax remitted to the City. <br />Beginning Jan. 1, 2023, an administrative credit would be applied to retailers that fall <br />under the HB21-1162 definition of "store." These retailers would continue to collect $0.25 <br />per bag. These retailers would continue to remit $0.15 to the City, which would then be <br />administratively divided into separate accounts for the tax and the fee, so that the funds <br />may be spent in compliance with use restrictions on the state bag fee. <br />The ordinance would also adjust the City's remittance schedule to match the state's <br />quarterly payment requirement and remove the exemption on farmers' market vendors in <br />the City bag ordinance. <br />Staff recommends approval of the ordinance. <br />Public Comments <br />RJ Harrington, 457 East Raintree Court, stated there is citizen support for eliminating <br />demand for new fossil infrastructure and reducing plastic use. He urged a yes vote. <br />
