City Council <br />Meeting Minutes <br />August 31, 2021 <br />Page 2 of 14 <br />Motion: Councilmember Fahey moved to approve the consent agenda, seconded by <br />Mayor Pro Tern Maloney. Vote: All in favor. <br />ORDINANCE NO. 1811, SERIES 2021 —AN ORDINANCE APPROVING THE FIRST <br />AMENDMENT TO CONOCOPHILLIPS CAMPUS GENERAL DEVELOPMENT PLAN <br />(REDTAIL RIDGE MASTER PLAN) — 2ND READING, PUBLIC HEARING (advertised <br />Daily Camera 7/18/21) continued from 7127121, 813121, & 8117121 <br />Mayor Stolzmann reopened the public hearing and asked for disclosures. Councilmember <br />Dickinson stated he wanted to be clear he had not made up his mind on the application. <br />He looks forward to more testimony and will take all the information into consideration in <br />his decision. <br />Mayor Stolzmann reminded everyone where the application is in the process. She noted <br />there will be one additional chance for public comments and applicant comments tonight. <br />Director Zuccaro reviewed the new information from the packet. It includes a proposal <br />from the applicant with revisions to the open space dedication, a reduction in the <br />maximum allowed building area, and a revision to the sustainability commitments. <br />City Attorney Kelly reminded everyone that the purpose of the meeting is for the Council <br />to continue to listen to evidence and to consider the application and evidence with the <br />applicable legal criteria from the municipal code. She noted that there is an additional set <br />of criteria in the state statute that says the City Council can require additional public land <br />dedications if additional factors are met (C.R.S. 29-20-201). It states that Council shall not <br />require additional land dedication unless one of two criteria are met: 1) there is an <br />essential nexus between the dedication and a legitimate City interest and 2) the <br />dedication is roughly proportional both in nature and extent to the impact of the proposed <br />use of the property. She reminded Council to apply the evidence and also to determine if <br />the criteria have been met or not. <br />Geoff Baukol, applicant presentation, stated that in the earlier hearings there were <br />requests for additional open space, more sustainability, and changes in density to protect <br />the pond. In response to what they heard, the now present an updated application that <br />increases the open space dedication by 20 acres, including areas that have not been <br />previously developed; they added electric HVAC and hot water for all buildings and <br />increased the solar installation minimum; they have reduced the building density around <br />the pond in Parcel C; and they removed gas stations as a permitted use in any parcel. <br />Councilmember Leh asked for confirmation that the solar would be on the buildings not on <br />the open spaces. Jordan Swisher stated the solar is not specifically depicted in the GDP <br />other than it is an allowable use. The most cost-efficient way to do the solar is on the <br />roofs but it may not be limited to that. That will be determined in the PUD process. <br />
