City Council <br />Meeting Minutes <br />December 21, 2021 <br />Page 6 of 12 <br />Councilmember Most stated the community members who show up are the ones who <br />have influence and are listened to. We should listen to the hundreds of emails we have <br />received. She noted her concern that the applicant has resources to affect this vote and <br />who may influence the uninformed voters. She feels it is a bad message to send to the <br />community that we are unwilling to reconsider something when so many people have <br />asked us to. <br />MOTION: Mayor Pro Tern Maloney called the question; Councilmember Fahey seconded. <br />VOTE TO END DEBATE: Motion failed with Mayor Stolzmann, Councilmember <br />Dickinson, Councilmember Leh, and Councilmember Most voting against the motion. <br />Mayor Stolzmann stated she feels even if this is approved with a vote, we have a divided <br />community and we will continue to have a divisive discussion for all future land use <br />hearings on this property and if it fails it could have a chilling effect on all land use <br />applications. We have control at this point to try to be less divisive by repealing it tonight. <br />Councilmember Leh stated that the change in Councilmembers that now allows for a <br />repeal does not mean we should not let this process play out. He stated making a <br />decision to repeal based on the threat of a popular vote is a precedent he does not want <br />to set. It is messy but that is the process. <br />Councilmember Fahey stated the referendum process requested a vote and that is what <br />she supports. If the residents want to overturn a vote of the council it should be done by a <br />vote of all registered voters. <br />Mayor Stolzmann closed the public hearing. <br />VOTE ON SUBSTITUTE MOTION TO APPROVE ORDINANCE NO. 1819: Motion failed <br />on a 4-3 vote with Mayor Pro Tern Maloney, Councilmember Leh, Councilmember Fahey, <br />and Councilmember Dickinson voting no. <br />Mayor Stolzmann asked City Attorney Kelly what the Council process would be in the <br />election. City Attorney Kelly noted that if this item is sent to an election the Council no <br />longer has a role in the land use process and the quasi-judicial process has ended. With <br />that Councilmembers would then be able to participate like all other residents in the <br />election process. <br />VOTE ON ORIGINAL MOTION TO APPROVE RESOLUTION NO. 90 WITH APRIL 19 <br />ELECTION DATE: Motion passed on a 6-1 vote with Councilmember Most voting no. <br />RESOLUTION NO. 93, SERIES 2021 — A RESOLUTION APPROVING A PLANNED <br />UNIT DEVELOPMENT AMENDMENT TO ALLOW FOR THE CONSTRUCTION OF <br />EXTERIOR SITE RENOVATIONS WITH WAIVERS, INCLUDING THE REMOVAL OF <br />
