Boulder C0un~y Clerk, CO 0R0 R ~5,8t~ 0 8.B~ <br />ORDINANCE NO. 1307 <br />SERIES 1999 <br /> <br />AN ORDINANCE DESIGNATING CERTAIN GEOLOGIC HAZARDS WITHIN THE <br />BUSINESS CENTER AT C.T.C. AND ADOPTING GUIDELINES AND REGULATIONS <br />FOR THE ADMINISTRATION THEREOF, PURSUANT TO ARTICLE 65.1 OF TITLE 24, <br />COLORADO REVISED STATUTES. <br /> <br /> WHEREAS, pursuant to C.R.S. §24-65.1-101 et seq. ("House Bill 1041"), the City is <br />authorized to designate areas and activities of state interest and to adopt guidelines and regulations <br />for the administration of such areas and activities of state interest; and <br /> <br /> WHEREAS, pursuant to House Bill 1041, the City has previously adopted general <br />administrative regulations concerning areas and activities of state interest, which regulations are <br />contained in Chapter 17.32 of the Louisville Municipal Code; and <br /> <br /> WHEREAS, pursuant to House Bill 1041, the City by Ordinance Nos. 501 and 507, Series <br />1976, designated certain areas within the Colorado Technological Center ("C.T.C.") as geologic <br />hazard areas and adopted guidelines and regulations for the administration of such areas; and <br /> <br /> WHEREAS, since that time, a Mine Closure Shaft Report ("Report") has been prepared for <br />the Nonpareil Mine affecting portions of C.T.C., which Report was prepared June 1989 by <br />Montgomery-Phillips, Inc. and updated August 1989; and <br /> <br /> WHEREAS, the Report indicates that there are shafts located within Lot 5, Block 7, the <br />Business Center at C.T.C., which shafts have not previously been designated as geologic hazard <br />areas; and <br /> <br /> WHEREAS, pursuant to House Bill 1041, the City desires to designate such shafts as <br />geologic hazards and adopt additional guidelines and regulations for their administration; and <br /> <br /> WHEREAS, the City Council has determined that uncontrolled development in and around <br />such shafts, as geologic hazards areas of potential ground subsidence, pose a significant risk to <br />public health and safety and to property, could result in unnecessary economic loss, and that such <br />areas are a matter of statewide concern; and <br /> <br /> WHEREAS, at a public hearing held on August 3 and September 7, 1999 ("the Public <br />Hearing"), the City Council considered this Ordinance to designate such shaft areas as geologic <br />hazards areas and areas of state interest; and <br /> WHEREAS, at the Public Hearing, the City Council considered the documents presented <br />and the testimony of the City Planning Department staff, City Attorney, and interested members of <br />the public, all of which documents and testimony are included in the record of the Public Hearing; <br />and <br /> <br /> <br />
