(a) there is filed within ten (10) days of the date of the Notice of Decision a written request for a rehearing; and (b) the written request sets forth the grounds for rehearing, which shall be limited to lack of jurisdiction, misrepresentations of another party, mistake of face, or the discovery of new evidence which could not be presented at the previous hearing; and (c) the rehearing is conducted and a decision rendered within thirty (30) days of the date the Notice of Decision on the original appeal is made and signed; and (d) there is a successful motion by any Board member to reconsider a decision. Section 9. Conflict of Interest. No member of the Board shall participate in any discussion or voting on any matter before the Board in which the member believes there is a personal professional or financial interest or conflict, pursuant to applicable state statutes and City ordinances. ARTICLE 6 AMENDMENTS Section 1. Amendments to these Rules of Procedure may be made by the Board at any regular meeting upon an affirmative vote of a majority of those members present. A copy of these Rules of Procedure and any amendment thereto shall be kept on file with the Building Official and made available to interested parties upon request. Amendments may be recommended by any Board Member, the Building Official, the City Council, or the City Attorney. ARTICLE 7 CONFLICT OF LAW Section 1. Where any conflict exists between any provision of these rules of procedure and the ordinances of the City or applicable state statute, such ordinance or applicable state statute shall control over the provisions of these rules of procedure and these rules of procedure shall be deemed to have been amended to conform to such ordinances or applicable state statute.
