<br />(a) there is filed within ten (10) days of the date of the Notice of Decision a written <br />request for a rehearing; and <br />(b) the written request sets forth the grounds for rehearing, which shall be limited to <br />lack of jurisdiction, misrepresentations of another party, mistake of face, or the <br />discovery of new evidence which could not be presented at the previous <br />hearing; and <br />(c) the rehearing is conducted and a decision rendered within thirty (30) days of the <br />date the Notice of Decision on the original appeal is made and signed; and <br />(d) there is a successful motion by any Board member to reconsider a decision. <br /> <br />Section 9. Conflict of Interest. No member of the Board shall participate in any discussion or <br />voting on any matter before the Board in which the member believes there is a personal <br />professional or financial interest or conflict, pursuant to applicable state statutes and City <br />ordinances. <br /> <br />ARTICLE 6 <br />AMENDMENTS <br /> <br />Section 1. Amendments to these Rules of Procedure may be made by the Board at any regular <br />meeting upon an affirmative vote of a majority of those members present. A copy of these Rules of <br />Procedure and any amendment thereto shall be kept on file with the Building Official and made <br />available to interested parties upon request. Amendments may be recommended by any Board <br />Member, the Building Official, the City Council, or the City Attorney. <br /> <br />ARTICLE 7 <br />CONFLICT OF LAW <br /> <br />Section 1. Where any conflict exists between any provision of these rules of procedure and the <br />ordinances of the City or applicable state statute, such ordinance or applicable state statute shall <br />control over the provisions of these rules of procedure and these rules of procedure shall be <br />deemed to have been amended to conform to such ordinances or applicable state statute. <br /> <br />ADOPTED this <br /> <br />day of <br /> <br />,2009. <br /> <br />CITY of LOUISVILLE <br />BUILDING CODE BOARD OF APPEALS <br /> <br />Chairperson <br /> <br />ATTEST <br /> <br />Chief Building Official/Secretary <br />
