Question called for. All in favor. <br />Motion carried unanimously. <br /> <br />Councilmembers had a copy of the resolution <br />as well as staff report, related maps and <br />Subdivision Agreement; and Attorney Rauten- <br />straus read it in its entirety. The Attorney <br />also advised that the permit numbers had been <br />placed in the subdivision agreement - 1984 <br />22, 1985 - 22, and 1986 - 20 permits. <br /> <br />Stated that formerly the plan was brought be- <br />fore Council and included both townhouses and <br />single family development. Now it is totally <br />for single family development, located on <br />the north side of South Boulder Road, zoned <br />residential low density, consists of 19.9 <br />acres, lies next to the Hunter's Ridge Sub- <br />division which would be the next item on the <br />agenda; depicted on the map the points of <br />access which met approval of the Fire Mar- <br />shall. Applicant's request was to build <br />64 single family homes. Plat was consis- <br />tent with the Comp Plan - developer is dedi- <br />cating 1.3 acres to the City and will pay an <br />additional 5.3% cash-in-lieu to meet the 12% <br />dedication requirement. Staff and Planning <br />Commission recommended approval. <br /> <br />Was representing Mr. Vic Caranci, owner and <br />developer of the site. The number of units <br />had been reduced from 76 to 64. Mr. Drumm <br />stated there were a few problems with the <br />subdivision agreement from their perspective; <br />one a "forever" type of idemnification on <br />drainage, they felt was an undue hardship. <br />Another of the problems was the "up to" <br />numbers on the building permits - did not <br />feel this was fair to the developer as Council <br />could change the agreement at any time. <br />Developer was requesting Council's approval <br />of the plat and the agreement had been signed <br />by Mr. Caranci. <br />
