<br />Councilman Cummings <br /> <br />Vote on the Motion <br /> <br />AUDIENCE COMMENTS <br /> <br />~ITY ATTORNEY'S REPORT <br />ORDINANCE #807 - CONTRACTOR'S <br />LICENSE FEE INCREASE - <br />PUBLIC HEARING <br /> <br />Councilman Cussen <br /> <br />9/6/83 <br /> <br />Page -9- <br /> <br />Inquired of the City Attorney if council <br />could take this position. <br />Attorney Rautenstraus felt that the motion <br />was totally based upon defendents other than <br />the City; therefore didn't feel it would cause <br />a problem with respect to the City's defense <br />to the suit. Further advised that it was <br />a policy type statement not any type of legally <br />binding statement by Council. <br />Councilman Leary stated that he felt the intent <br />of the motion was to put this in the form of <br />a letter and mail it to the attorneys repre- <br />senting Medema/Warembourg or to them indivi- <br />dually. <br />Discussion by councilmembers with Leary, Morris, <br />and Cussen defending the right of referendum <br />for citizens and Councilmen Fauson and Cummings <br />defending the right of the developer and <br />property owner. <br /> <br />Question called for. All in favor. Motion <br />carried unanimously. <br /> <br />None <br /> <br />Councilmembers had a copy of the ordinance; <br />Attorney Rautenstraus read it by title only <br />on second reading and public hearing and certi- <br />fied proper publication. <br />Mayor Meier opened the public hearing and <br />Attorney Rautenstraus certified proper publi- <br />cation of the public hearing notices. <br />Director Rupp advised that the Chief Building <br />Official had recommended the revision in fees <br />relative to the Uniform Building Code and the <br />Attorney was instructed to initiate the ordin- <br />ance. <br />Mayor Meier continued the public hearing and <br />asked if there were any public comments in <br />support of Ordinance #807. None <br />Anyone in opposition - None. Any public com- <br />ments or questions - none. Council comments. <br />Inquired what the percentage of increase was <br />on the fees. <br />Attorney Rautenstraus stated he did not know <br />the percentage; were not large increases, but <br />were more in line with covering costs to the <br />City with respect to issuance of licenses, etc. <br />Also advised that the fees had not been up-dated <br />for 5 years. He then read the increases. <br />Cussen wished additional input from the Chief <br />Building Inspector on why some of the fees <br />
