<br />ADOPTION - RES. #26 <br /> <br />WAREMBOURG ANNEXATION <br />REFERENDUM PETITION <br /> <br />MOTION TO REPEAL ORDINANCE #791 <br /> <br />Mayor Meier <br /> <br />8/2/83 <br /> <br />Page -9- <br /> <br />Councilman Leary moved, Councilman Cussen <br />seconded that Resolution #26 - pine St. <br />Plaza - Replat and P.U.D. be adopted. Question <br />called for. All in favor. Motion carried <br />unanimously. <br /> <br />Attorney Rautenstraus advised that referendum <br />petitions with respect to Ordinance #791 - <br />Warembourg Annexation were filed with the <br />City within 30 days after final publication. <br />The City Clerk had verified a sufficient <br />number of signatures. Under State Statutes <br />Council has the alternative to repeal the <br />Ordinance or set an election. If it is <br />set for an election it may be set at a <br />regular or special election between 60 and <br />150 days from the date the petitions were <br />filed. They were filed July 15, 1983. The <br />November Municipal Election does fit within <br />those parameters. <br /> <br />Councilwoman Morris moved, Councilman Leary <br />seconded that Ordinance #791 - An Ordinance <br />Annexing to the City of Louisville, Colorado, <br />a Parcel of Approximately 91.7 Acres Located <br />West of Dutch Creek Subdivision and East <br />of Heritage II Subdivision, Which is Owned <br />by Klubert Warembourg be repealed. <br /> <br />Commented at this time he would not necessarily <br />like to see this ordinance repealed but would <br />rather it go to a vote of the people. Because <br />a lot of discussion had been going on with <br />councilmembers as far as the City's future <br />growth and it was his feeling that this had <br />already been presented as a slow growth type <br />response to this annexation. He felt since <br />it was already presented as such he thought <br />it would almost behoove the City and Council <br />to let the people vote on how they would like <br />to have their growth and get that question <br />answered once and for all. As it was presented, <br />it was not the Warerobourg annexation that we are <br />opposing, we are opposing the fast growth <br />then he felt that would answer the questions <br />for the voting public, for Council and every- <br />one else; then everyone can work off the <br />same base. Rather than haveing it dropped <br />at this time and trying to come up with <br />something else as appropriate would just as <br />well have it on the November ballot. <br />
