<br />ORDINANCE #805 - INDUSTRIAL <br />REVENUE BONDS - LOUISVILLE <br />MEDICAL CENTER <br /> <br />PUBLICATION AUTHORIZED <br /> <br />ACCEPTANCE OF CITY ATTORNEY'S <br />REPORT <br /> <br />CITY ADMINISTRATOR I,S REPORT <br />VELDKAMP WATER AGREEMENT - <br />5 'SHARES-11ARSHALL WATER <br /> <br />TABLED <br /> <br />SUITTS WATER AGREEMENT - HOWARD <br />MC GINN EXCHANGE - DRY CREEK <br />PURCHASE <br /> <br />AUTHORIZATION FOR MAYOR AND <br />CLERK TO SIGN THE AGREEMENTS <br /> <br />Mayor Meier <br /> <br />7/5/83 <br /> <br />Page -7- <br /> <br />Councilmembers had a copy of the ordinance; <br />Attorney Rautenstraus read it by title only <br />on first reading and the request was for pub- <br />lication. <br /> <br />Councilman Cussen moved, Councilman Cummings <br />seconded that Ordinance #805 - Industrial <br />Revenue Bonds - Louisville Medical Center <br />be published. Question called for. All in <br />favor. Motion carried unanimously. <br /> <br />Councilman Fauson moved, Councilman Cummings <br />seconded that the City Attorney's report be <br />accepted and placed on file. Question called <br />for. All in favor. Motion carried unanimously. <br /> <br />Administrator Wurl requested this item be <br />tabled because the signed agreement had not <br />been received. <br /> <br />Councilman Leary moved, Councilman Cummings <br />seconded that the Veldkamp Water Agreement <br />be tabled. Question called for. All in <br />favor. Motion carried unanimously. <br /> <br />Councilmembers had a copy of the agreement. <br />Administrator Wurl advised the terms of the <br />agreement provide for the purchase of Dry <br />Creek water shares and exchange of McGinn <br />water shares for Howard water shares. Primarily <br />Howard water is the oldest right on the ditch <br />and one that the City has more water in than <br />McGinn and Mr. Suitts can utilize McGinn water <br />better in terms of irrigation. Recommendation <br />was for the Mayor and Clerk to sign the Agree- <br />ment as relates to the exchange and payment; <br />and also authorize the outright purchase of <br />Dry Creek #2 water shares. <br /> <br />Councilman Fauson moved, Councilman Cussen <br />seconded that the Mayor and Clerk be authorized <br />to sign the Water Agreements for Howard - <br />McGinn Exchange and purchase of Dry Creek <br />water shares. <br /> <br />Referred to section 2. of the Dry Creek <br />purchase agreement - "Upon application by <br />Seller for a City of Louisville water tap, the <br />escrowed funds shall be reduced by the amount <br />of the then current cost of the taps applied <br />for - felt that a limit should be placed on <br />the number of taps Mr. Suitts could obtain <br />
