Amendment to Ordinance #749

5/18/83

Page - 21 -

Stated there are two entirely separate issues.
If the majority of this council defeats the
petition from the people to resind the annexa-
tion, it is the responsibility of this Coun-
cil to put it to a vote. But the first issue
must be dealt with first, and dealt with on
its merits. Each council person must ask
do I agree that this land - open space land _
should not violate our comp plan - should not
put commercial zoning on open space land, etc.
All the reasons that have been stated here
this evening. Councilmembers have to be able
to say they disagree with the comp plan;
disagree with our circling the City with open
space; disagree with protecting our interest
to the City, etc. Felt that it had to be very
clear the issue to be voted upon is not
whether to go to a vote; the issue is a re-
quest of the people to rescind the ordinance.
Should Council decide to pass this ordinance
any other citizen has the right to turn that
around and come in here and have an election
on the ordinance we are passting tonight.
The official petition that was brought to us
under the Constitution of the State of Colo-
rado asks us to decide - asks us to repeal
the law we passed. If we decide not to do
that, we have no coice but to put it to a
vote. Didn't feel councilmembers were going
to behave like the last Council and try to
be pigger than the Constitution of Colorado.
The proper manner he felt was to deal with
Ordinance 1049

Councilman Leary moved to amend Ordinance #794
as follows:
A. The proposed zoning of this parcel is
inconsistent with zoning in the City
of Louisville.
B. The annexation of this parcel with this
proposed zoning would interrupt the es-
tablishment of an open space buffer
around the City of Louisville.
C. The annexation of this parcel with this
proposed zoning would be in contradiction
of the City's desire to protect its
interest from development.
D. The proposed zoning of this parcel is
inconsistent with the zoning of adjacent
parcels of property. Even with the
existing zoning it does not abut any
commercial. It still abuts residential
and agricultural.
