<br />Amendment to Ordinance #749 <br /> <br />5/18/83 <br /> <br />Page - 21 - <br /> <br />Stated there are two entirely separate issues. <br />If the majority of this council defeats the <br />petition from the people to resind the annexa- <br />tion, it is the responsibility of this Coun- <br />cil to put it to a vote. But the first issue <br />must be dealt with first, and dealt with on <br />its merits. Each council person must ask <br />do I agree that this land - open space land _ <br />should not violate our comp plan - should not <br />put commercial zoning on open space land, etc. <br />All the reasons that have been stated here <br />this evening. Councilmembers have to be able <br />to say they disagree with the comp plan; <br />disagree with our circling the City with open <br />space; disagree with protecting our interest <br />to the City, etc. Felt that it had to be very <br />clear the issue to be voted upon is not <br />whether to go to a vote; the issue is a re- <br />quest of the people to rescind the ordinance. <br />Should Council decide to pass this ordinance <br />any other citizen has the right to turn that <br />around and come in here and have an election <br />on the ordinance we are passting tonight. <br />The official petition that was brought to us <br />under the Constitution of the State of Colo- <br />rado asks us to decide - asks us to repeal <br />the law we passed. If we decide not to do <br />that, we have no coice but to put it to a <br />vote. Didn't feel councilmembers were going <br />to behave like the last Council and try to <br />be pigger than the Constitution of Colorado. <br />The proper manner he felt was to deal with <br />Ordinance 1049 <br /> <br />Councilman Leary moved to amend Ordinance #794 <br />as follows: <br />A. The proposed zoning of this parcel is <br />inconsistent with zoning in the City <br />of Louisville. <br />B. The annexation of this parcel with this <br />proposed zoning would interrupt the es- <br />tablishment of an open space buffer <br />around the City of Louisville. <br />C. The annexation of this parcel with this <br />proposed zoning would be in contradiction <br />of the City's desire to protect its <br />interest from development. <br />D. The proposed zoning of this parcel is <br />inconsistent with the zoning of adjacent <br />parcels of property. Even with the <br />existing zoning it does not abut any <br />commercial. It still abuts residential <br />and agricultural. <br />
