PERMIT TRANSFER <br />PUBLIC HEARING <br /> <br />CONTINUANCE OF PUBLIC HEARING <br /> <br />5/18/83 <br /> <br />Page -9- <br /> <br />Director Rupp advised it would be stated <br />in the Annexation Agreement. Recalled <br />that an Exhibit C was mentioned in the agree- <br />ment, which is a schematic sketch plan and <br />could be attached to the agreement for Coun- <br />cil's consideration on the density. It could <br />stipulate the type of structure Council <br />would prefer. <br /> <br />Wished clarification to be certain that the <br />density issue would be reviewed by the Plan- <br />ning Commission. <br />Director Rupp stated Planning Commission had <br />reviewed the zoning, number of units, and <br />density. There was nothing discussed about <br />the possible transfer of density for dedi- <br />cated portion of South Boulder Road. With- <br />out seeing a site plan, the Planning Com- <br />mission felt that the R-M zoning was appro- <br />priate for the site. <br /> <br />Councilwoman Morris moved, Councilman Leary <br />seconded that Ordinance #790 - Rickman-Moses <br />Zoning be adopted. Roll call vote: <br />Fauson Yes <br />Ferrera Yes <br />Cummings Yes <br />Morris Yes <br />Cussen Yes <br />Leary Yes <br />Motion carried unanimously. <br /> <br />Councilmembers had a copy of the ordinance; <br />Attorney Rautenstraus read it by title only <br />on second reading, public hearing and certi- <br />fied proper publication. <br />Mayor Pro-tern Fauson opened the public hearing. <br />Attorney Rautenstraus certified proper pub- <br />lication of the public hearing. Rautenstraus <br />then advised Council that the applicant - <br />Scripps-Howard Cable Services requested that <br />this public hearing be continued until June <br />7, 1983, as they had some minor matters to <br />resolve before entering into the amendment <br />to the permit agreement. <br /> <br />Councilman Cussen commented he and Council- <br />woman Morris still had concerns regarding <br />the amendment to the permit agreement after <br />meeting with the Scripps-Howard representa- <br />tives. He also wished to know of any concerns <br />
