SPECIAL EVENTS LIQUOR LICENSE APPLICATION PUBLIC HEARING 2/1/83 AUDIENCE COMMENTS CITY ATTORNEY'S REPORT ORDINANCE #779 - AMENDING ZONING REGULATIONS PUBLICATION AUTHORIZED '::ounc ilman Leary 1/18/83 Page -3- Thanked Mrs. Maagoe for being present at the meeting and welcomed her to the Library Board. Attorney Rautenstraus advised that the ap- plication was in order. Councilman Fauson moved, Councilman Ferrera seconded that the Louisville Fire Dept. Special events liquor license application be accepted and the public hearing be set for February 1, 1983. Question called for. All in favor. Motion carried unanimously. None Councilmembers had a copy of the ordinance; Attorney Rautenstraus read it by title only on first reading and the request was for publication. Councilman Cummings moved, Councilman Ferrera seconded that Ordinance #779 - Amending Zoning Regulations be published. Requested Attorney Rautenstraus to enumerate the changes tha.t had been made. Rautenstraus advised the changes in the Board of Adjustment section were basically house- keeping in nature, i.e. the Chairman could be elected by a majority vote; also matters other than variances and overtunrning decisions made by the zoning administrator can be made by a majority vote. Presently there is some question as to which way the vote would have to go. It is possible that it could be ar- gued that four votes would be required to take any action which needed clarification, for items which specifically aren't set forth by state statutes to require four members. Relative to appeals-provided for the property owners within 500' of the property to be noti- fied. With respect to the building permit section, provided that they could be reviewed by all appropriate departments of the city. Also added a section which requires before a building permit is to be issued on a parcel of property the owner must go through the subdivision process.
