Councilman Leary
Subdivision Process Before
Building Permit Issued

Councilman Cussen
Fees

Councilwoman Morris

1/18/83

Page -4-

The last section involves solar devices and
sets forth conditions for their approval
with respect to maximum heighth.

Inquired what the significance was of the
change requiring completion of the subdivision
process before the building permit is issued.
Rautenstraus advised at the present time there
are some situations whereby a property owner
can simply come in and obtain a building per-
mit and construct a building without doing
anything other than meet building code r~quirements.
There have been a few times when possibly
improvements did not have to be met, i.e.
streets, etc. This would give all departments
an opportunity to review these situations.
Director Rupp remarked the subdivision process
is intended to provide for the orderly develop-
ment of the City, placement of the streets,
easements, etc. and could therefore make
certain that a structure would not be built
on a proposed street or easement.
Councilman Leary asked how this would effect
lots in the older part of town who wished to
subdivide their property.
Rupp stated these could be brought before
the Variance Board as some sort of a hardship
process. The intent of this provision was
for the new subdivisions.

Requested clarification on the Appeals section -
"the fee shall be ~ of the zoning amendment
fee." What is this fee?
Rupp advised presently it is $50.00.
Cussen inquired if this fee included the cost
of mailing to the property owners within 500' .
Rautenstraus advised it included the mailing
costs.

Wished a chan~e be made in the ordinance -
<.:>
presently read that no more than 2 members
of the Board of Adjustments and Appeals may
be current members of the city Planning Com-
mission - wished this changed to read "none"
of the members of the Board of Adjustments
and Appeals Board may be current members of the
city Planning Commission.
