City Council
Meeting Minutes
March 3, 2009

City Manager Fleming thanked Ms. Hogan for her dedicated work in Louisville
over the past two years. He praised her expertise in working with businesses,
Business Assistance Packages (BAP) and her economic development efforts.

COUNCIL COMMENTS

Councilor Dalton commended Ms. Hogan for her work with the Business
Retention and Development Committee (BRAD).

Mayor Sisk expressed his sincere thanks to Ms. Hogan.

RESOLUTION No.9, SERIES 2009 - A RESOLUTION APPROVING A
REQUEST FOR A SPECIAL REVIEW USE (SRU) PERMIT TO ALLOW FOR
THE PLACEMENT OF AN ALTERNATIVE TOWER STRUCTURE (ATS) CMRS
FACILITY ON PROPERTY OWNED BY CONOCOPHILLlPS

Mayor Sisk requested a Staff presentation.

Planning Director Wood explained the applicant Sprint Nextel, is requesting an
Alternative Tower Structure (ATS) monopole on the ConocoPhillips property. An
ATS in the industrial zone district requires approval of a special review use.

Sprint Nextel currently has their cellular equipment located on the roof of building
2A on the ConocoPhillips property, which will be demolished. Therefore, Sprint
Nextel must find an alternative location for their cell equipment. According to the
letter of intent, the applicant states the ATS will act as a temporary solution for
cell equipment placement until ConocoPhillips has constructed a new building in
the immediate location. The Planning Staff recommends this A TS be reviewed
as a permanent structure.

The A TS is designed to match the existing Excel Energy transmission poles
located on the property. The cell equipment and dish would be located within a
monopole and painted to match the color of the transmission pole. The design
would blend in with the existing pole structure. The requested height is 80 feet,
however the maximum height established in the Industrial Zone District is 50 feet.
The proposed ATS complies with the required setbacks.

The applicant proposes to locate the ground mounted mechanical units (GMMU)
adjacent to the proposed ATS. The site required is approximately 10 feet X 15
feet, and will be located on a concrete pad. The GMMU cabinet will stand
approximately 5 feet 10 inches.

Sprint Nextel is a licensed provider by the FCC and will comply with all applicable
FCC rules pertaining to the CMRS facility, including regulations regarding human
health and exposure to radio frequency emissions.
