City Council
Meeting Minutes
April 7, 2009

owners (five) have been notified of the proposed easement vacations. Staff has
not received any objections to the vacation.

Mayor Sisk requested public comment and hearing none, closed the public
hearing.

MOTION: Councilor Muckle moved to approve Ordinance No. 1547, Series 2009
on second and final reading, seconded by Councilor Dalton. Roll call vote was
taken. The motion carried by a vote of 7-0.

SALE OF THE DAMYANOVICH HOMESTEAD PARCEL
RESOLUTION No. 13, SERIES 2009 - A RESOLUTION APPROVING THE
SALE OF A 1.2 ACRE PARCEL OF REAL PROPERTY LOCATED IN
UNINCORPORATED BOULDER COUNTY AT 7507 DYER ROAD,
LOUISVILLE, COLORADO

ORDINANCE No. 1548, SERIES 2009 - AN ORDINANCE APPROVING SALE
OF THE DAMYANOVICH HOMESTEAD PARCEL _1ST READING

Mayor Sisk requested a City Attorney introduction.

City Attorney Light read Ordinance No. 1548, Series 2009.

City Manager Fleming explained the City of Louisville is the owner of a 1.2-acre
parcel of real property located in unincorporated Boulder County. The street
address is 7507 Dyer Road, Louisville, Colorado and is commonly referred to as
the Damyanovich Homestead Parcel. This parcel was subdivided from the 13-
acre Damyanovich Open Space Property when it was purchased in July of 2007.

The property contains an existing house, barn and accessory building, which was
not acquired for and is not being held or used for any park, open space,
municipal or governmental purposes. It was acquired solely as excess property
and a general asset to be sold and disposed of in order to help defray the costs
of the City's acquisition of adjacent open space. Rachael and Greg Kras
submitted a proposed purchase contract to buy and sell real estate for sale of the
property for $415,000, through the City's real estate broker Steve Anderson.

The sale of the homestead parcel, along with Boulder County's $200,000
conservation easement payment will off-set a significant portion of the City's
initial cost for the Damyanovich Open Space Property.

City Attorney Light reviewed a revision to Resolution No. 13, Series 2009, which
includes a provision ratifying the City Manager's execution of the purchase
contract.
