<br />City Council <br />Meeting Minutes <br />April 7, 2009 <br />Page 8 of 11 <br /> <br />Councilor Muckle inquired as to the changes in the Water Fund. Public Works <br />Director Phare stated the increase reflects the Windy Gap project. <br /> <br />Councilor Muckle asked for clarification on the summary of all the funds. Finance <br />Director Watson noted the changes are due to decreases in the C-I-P in the <br />original budget. <br /> <br />Councilor Muckle suggested using the LED lights in the Library parking lot. <br />City Manager Fleming stated it was their intent to install LED lights in the parking <br />lot. Public Works Director stated with the earlier LED lights, there was an <br />inconsistency of quality standards. LED lights will be used providing they meet <br />the City's standards for reliability and performance. <br /> <br />VOTE: Roll call vote was taken. The motion carried by a vote of 7-0. <br /> <br />ORDINANCE No. 1547, SERIES 2009 - AN ORDINANCE APPROVING THE <br />VACATION OF TEMPORARY SECONDARY EMERGENCY VEHICLE <br />ACCESS EASEMENT AND TEMPORARY BIKE PATH EASEMENTS <br />LOCATED WITHIN LOTS 2,3,4, AND 6, BLOCK 4, AND LOT 8, BLOCK 5, <br />SPRUCE LANE SUBDIVISION WITHIN THE CITY OF LOUISVILLE - Public <br />Hearing <br /> <br />Mayor Sisk requested a City Attorney introduction. <br /> <br />City Attorney Light read Ordinance No. 1547, Series 2009. <br /> <br />Mayor Sisk opened the public hearing and requested a Staff presentation. <br /> <br />Planning Director Wood explained when the Spruce Lane Subdivision was <br />platted in 1987 a "temporary secondary emergency vehicle access easement" <br />and a "temporary bike path easement" were dedicated to the City of Louisville. <br />The owners of the lots encumbered by the temporary secondary emergency <br />vehicle access easement and the temporary bike path easement have requested <br />the easements be vacated. These easements are no longer required to provide <br />emergency access or a bike path. The vacation will not result in an alteration of <br />any of the property lines within the subdivision. The 10 foot wide utility easement <br />located in the same location will not be vacated. The temporary bike path <br />easement was granted prior to construction of the current multi-use trail through <br />Walnut Park. The Parks and Recreation Department and the Louisville Fire <br />Protection District have reviewed and support the proposal. <br /> <br />The language of the subdivision plat noted the temporary secondary emergency <br />vehicle access easement was to be vacated upon extension of West Walnut <br />Street. West Walnut Street was never extended. All of the affected property <br />
