<br />City Council <br />Meeting Minutes <br />May 5,2009 <br />Page 7 of 12 <br /> <br />Councilor Sackett requested other communities be surveyed to determine how <br />they handle those situations. City Manager Fleming noted the resolution was <br />based on a Lakewood resolution. He also polled other City Managers over the <br />listserve about the subject and received similar feedback. <br /> <br />Councilor Yarnell questioned excused absences and inefficiency and asked for a <br />definition. She asked if questioning a policy was a violation. She voiced her <br />concern over the City Manager being the decision maker and suggested the <br />liaisons should bring this information forward. <br /> <br />City Attorney Light explained the resolution stipulates the process, through the <br />liaisons to the City Manager, however the final decision will be decided by the <br />City Council. He stressed both parties must have an opportunity to appear and <br />present evidence before the Council. He noted whether it is the liaisons or the <br />City Manager that assembles the information, the City Council must make the <br />decision. <br /> <br />Councilor Yarnell asked who else could file a complaint. City Attorney Light <br />explained there does not necessarily have to be a third party complainant. If the <br />liaison or staff member recognized a cause for concern, the City would bring <br />forward the complaint. <br /> <br />Mayor Pro Tem Marsella warned against too much specificity in the definitions <br />because that could make it hard to remove someone who's behavior was clearly <br />objectionable if it was not something specifically listed. <br /> <br />Mayor Sisk stated there is no current process for the City to address board or <br />commission members that might commit felonies. City Attorney Light stated each <br />case would then require a process to address the issue. <br /> <br />Mayor Sisk stated the resolution is too broad based and suggested it might be <br />helpful to send the resolution to the various City boards and commissions for <br />their comment and he asked Council and the City Manager for their thoughts on <br />that approach. <br /> <br />Councilor Dalton favored a generally worded resolution compliant with the <br />Charter. <br /> <br />City Manager Fleming asked Council to review the grounds for removal listed in <br />the resolution and reflect on whether they would want someone to continue <br />serving on a board and commission if they had behaved in any of the ways listed. <br />He said that in regard to the Mayor's question about a review of the resolution by <br />all the boards and commissions, the board and commissions have sufficient work <br />
