<br />City Council <br />Meeting Minutes <br />June 2, 2009 <br />Page 5 of 17 <br /> <br />· Section 4 - Contingency/Emergency Reserve Funds - In the first year of <br />the existence of the HPF, 20% of the funds shall be placed in a <br />Contingency/Emergency Reserve. On an annual basis the HPC and City <br />Council shall reevaluate how much should be allocated to this Reserve. <br />These funds shall be accessed only in exigent circumstances, upon the <br />recommendation of the HPC and the approval of the City Council. <br />"Exigent circumstances" shall mean the HPC has determined, with <br />concurrence with the City Council, without urgent action significant <br />damage will be done to the historic fabric or character of Louisville. <br /> <br />Public Relations Manager Muth explained the Historic Preservation Commission <br />worked very hard on the resolution. Councilors Muckle and Dalton reviewed the <br />resolution. <br /> <br />COUNCIL COMMENTS <br /> <br />Councilor Dalton suggested the following amendments to the resolution: On page <br />2, Section 1 b, regarding the HPC making recommendations for all expenditures, <br />he suggested striking word "all". On Page 4, Section 3b iii, he suggested the <br />word "rebates" be replaced by "reimbursements." On page 5, Section 3f, the last <br />sentence, with respect to the allocation of funds, he suggested modifying the <br />sentence to read "the allocation of these funds can be modified at anytime by <br />City Council". On Page 5, Section 3e, the sentence regarding the divestment of <br />any conservation easement requiring approval by a majority of voters be <br />modified to stipulate divestment of any conservation easement shall require <br />approval by a majority of the City Council. <br /> <br />Mr. Whiteman responded to Councilor Dalton's comments. With respect to the <br />word "all" on Page 2, the HPC feel it is appropriate for the Commission to review <br />all applications. He noted that did not mean the Council would not see all <br />applications, or there was not an appeal or a public process. Mr. Whiteman had <br />no problem with changing the word "rebates" to "reimbursements." With respect <br />to divestments of conservation easements, the HPC believes in a system of <br />checks and balances and more than one public body should vote on the <br />divestment of conservation easements. Regarding the review on an annual <br />basis, versus any time of allocations, the HPC feel there should be some stability <br />to the fund and some capacity to plan and make recommendations. <br /> <br />Councilor Muckle thanked the HPC, City Staff and Councilor Dalton for all the <br />work they put into the resolution. He asked City Attorney Light if the resolution <br />adequately defines historic old town Louisville. City Attorney Light stated it <br />adequately defines by reference to the ballot issue, the Old Town Overlay and <br />the zoning ordinance gives a specific description. <br />
