<br />.ministrator Wurl <br /> <br />Councilman Leary <br /> <br />ACCEPTANCE OF COUNCIL co~mENTS <br /> <br />ADJOURNMENT <br /> <br />12/22/82 <br /> <br />Page -6- <br /> <br />Advised that is was for the 34% City share. <br />It was his personal feeling that it was the <br />fault of the developer that the Agreement was <br />not finalized in the required time frame. <br />The developer has been notified of this. <br /> <br />Inquired what the nature of the difficulty <br />was with the Agreement. <br />Wurl advised what the developer is attempting <br />to do by virture of the Agreement is to speak <br />to items in terms of future development, or <br />considerations on the property that Wurl didn't <br />feel the City should be doing. It was his <br />feeling that the problem wasJ1Qt _wi.th:~the .developer <br />but with the attorneys advising this was the <br />type of protection needed, etc. In cases <br />of recovery dealing with the full cost of <br />price of the taps versus that part of the <br />tap that relates to the plant expansion. <br />He was not comfortable with submitting the <br />Agreement in its present form to Council for <br />signature and to proceed to award the bid. <br /> <br />Councilwoman Morris moved, Councilman Ferrera <br />seconded that the council comments be accepted <br />and placed on file. Question called for. <br />All in favor. Motion carried. <br /> <br />Councilman Leary moved, Councilman Fauson <br />seconded that the continued meeting be ad- <br />journed. Question called for. All in favor. <br />Motion carried. Adjournment of continued <br />meeting at 8:00 P.M. <br />
