<br />Steve Yatchak <br />1091 Azure \Jay <br /> <br />ADOPTION OF ORDINANCE #774 <br /> <br />Counciman Leary <br /> <br />Attorney Rautenstraus <br /> <br />10/19/82 <br /> <br />Page -5- <br /> <br />Mr. Yatchak stated that he was president <br />of MCIC, which is the corporation of home- <br />owners that was recently involved in the liti- <br />gation against the City for zoning violation. <br />He was certain that everyone was aware of the <br />recent decision by the Court. He wished to <br />caution the council and the City with undue <br />optimism. As he saw it, and wanted to stress, <br />that this decision did not favor the City's <br />interpretation of zoning code use. Instead <br />what it did do 1N'as to establish the road map <br />under which the Mesa residents may preserve <br />environment and bring this injustice to an <br />inevitable conclusion. He wished to add it <br />is very infrequent in our daily lives that <br />we have the ability to rectify mistakes that <br />we have made in the past. Council is very <br />fortunate, in his opinion, they have an op- <br />portunity this evening. He stated they can <br />still say yes to the people, by saying no <br />to the industrial revenue bonds. He asked <br />that they send a message to the people, for <br />the people, as representatives of the people; <br />reverse the normal 5-2, or 4-3 customary vote <br />from the quick buck to individual human rights, <br />and preservation of people's daily lives. <br /> <br />Councilman Cummings moved, Councilman Ferrera <br />seconded Ordinance #774 - A. C. Nielsen Co. <br />Industrial Revenue Notes be adopted. <br /> <br />Commented that he was not certain that the <br />options Mr. Yatchak gave Council were the <br />only options, felt perhaps Council has another. <br />Asked Attorney Rautenstraus to summarize what <br />the Court ruling on the litigation was. <br /> <br />Replied he could summarize the ruling now, <br />if Council so wished, would do it in writing, <br />or a special meeting. <br />Councilman Leary requested this be done now. <br />Attorney Rautenstraus advised that on the <br />issues that had been before the Court, the <br />Judge ruled that for those issues the Corpora- <br />tion did not have standing and that the law <br />suit was filed prematurely. <br />Councilman Leary requested that Attorney <br />Rautenstraus comment on the road map comment <br />made by Mr. Yatchak. <br />
