<br />Councilwoman Morris <br /> <br />Motion to Table Ordinance #774 <br /> <br />Councilman Leary <br /> <br />10/5/82 <br /> <br />Page -14- <br /> <br />that if this Industrial Revenue Bond were <br />to be approved, it would be a travesty of <br />justice per se to offer the Mesa residents <br />as a sacrificial lamb to bring in a few <br />revenue dollars to the City. He full well <br />understood the predicament the City was in. <br />He would encourage Neodata to locate else- <br />where within the boundaries of the City rather <br />than to continue with the current proposal. <br />He commended Council on their sense of public <br />duty; but also asked them to certainly consider <br />all the other residents that have been neglected <br />in this whole issue; and as a Mesa resident <br />and there is a significant number of them. <br />He added there is also a large number of <br />residents throughout the City that are also <br />opposed to the proposal. The'yh,adnot circu- <br />lated additional petitions and knew of no <br />current activity or intent to do so, but <br />he knew of a number of people in Louisville <br />that are saying - don't let it happen. <br />He continued - if no postponement of the IRB <br />ordinance, he would again like to urge, hope- <br />fully that it is not too late, for_the City <br />to pursue the declaratory judgement thing to <br />get this whole zoning issue resolved. He <br />understood the stance of the City and also <br />understood with the litigation suit going on, <br />everyone would like to see this consummated. <br /> <br />Inquired if a motion to table the ordinance <br />can go on while there already is a motion. <br />Mayor Meier replied that it~ could. <br /> <br />Councilwoman Norris moved, Councilman Cussen <br />seconded to table the vote on the A. C. Nielsen <br />Industrial Revenue Bonds until there is some <br />legal determination on the current litigation. <br /> <br />Commented therE~ might not be agreement on the <br />motion, and inquired of Attorney Rautenstraus <br />as an alternative, could we ask the Court <br />to expedite this issue. <br />Attorney Rautenstraus advised this was the <br />posture that it was in presently, and the <br />Court has done so. He felt there would be <br />a decision on some of the motions this week. <br />Councilman Leary then asked, if the ordinance <br />was approved on second reading and the Court <br />ruled in favor of the residents, this action <br />could be adopted anyway, aouldn't it? <br />Attorney Rautenstraus felt that it ~ould.
