Councilman Leary then inquired if the Court ruled this was an improper use of that zoning would the City not be able to approve a build- ing permit? Rautenstraus felt something like this would occur. That would be a decision for the Judge to make. However he was of the opinion that it was in the loan documents, of course the project must meet the zoning requirements, if there was a Court determination that it did not, then financing would not be given. Councilwoman Morris Commented she felt it was premature to vote on something that the Court may, within a couple weeks, rule is not appropriate to even be there. Felt that Council should not take any type action until the Court makes a determination.
