She was curious if
the bank that the applicant was dealing with
knows that there is a litigation going.on
right now.

Mr. Len Perkins

Advised that the bank was aware of this
litigation - has been asking questions and
will make their own determinations. They
have had an opportunity to review the situ-
ation. Their c.ounsel assunes: the Colorado
Court will interpret that the City's ordin-
ance is consistent with the intended use.
Mr. Perkins wished to correct Attorney Rau-
tenstraus on the wording Industrial Revenue
Bonds should read Industrial Revenue Notes.

Councilwoman Morris

Also stated she had heard a rumor that the
reason their company wished to locate on the
Mesa was so that they could have some kind
of transmission tower to transmit to their
facility in Colorado Springs. These usually come
off data tapes. The computer that will run
the satellite to the Walnut St. building is
in Colorado Springs and will be located in
the Walnut Street building when the move is
made. It would not be financially feasible
to move it to the Louisville location.

Councilwoman Morris commented in February
of this year, Council passed criteria for
approval for Industrial Revenue Bonds. She
recalled the vote was a 4-3 vote. (Each
councilmember had a copy of the criteria
for IRB'S). She also stated each council-
member had a copy of a petition with 342
signatures from people living on the Mesa
that - indicate the criteria 118 - which
