APPROVAL OF THE AMENDMENTS TO ORDINANCE #769 MOTION TO ADOPT ORDINANCE #769 Councilwoman Morris MOTION TO SEPARATE COMMERCIAL AND OFFICE ZONING DEFEATED ROLL CALL VOTE - ORDINANCE 41769 AS AMENDED 9/7/82 Page -4- Rupp further advised there is a problem between the time the mailing lists are pro- vided and should the property change hands and has not been placed on the tax records. Councilwoman Morris moved, Councilman Leary seconded that the amendments to Ordinance #769 be adopted. Question called for. 6 Ayes - 1 Nay. Mayor Meier dissenting. Motion carried. Councilman Fauson moved, Councilman Cummings seconded that Ordinance #769 - Subdivision and Zoning Code Changes as amended be adopted. Expressed concern that Office Zoning was in- cluded with Commercial Zoning. She felt per- sonally that it was important to separate Commerical and Office zoning, since Director Rupp stated it would not make a difference. Director Rupp stated that basically land uses are kept in 3 categories - agritultural, housing, and commercial, and it would not pose a problem with his department, but may be confusing to the developer. Councilwoman Morris moved, Councilman Leary seconded that Commercial Zoning be separated into P.D.D. Commercial and P.D.D. Office and P.D.D. Residential and P.D.D. Agricultural in the Agricultural zone. Discussion held by Councilmembers and Director Rupp on the clarification proposed by Council- woman Morris. Roll call vote Meier Fauson Leary Ferrera Cummings Cussen Morris Motion defeated on the motion. No No Yes No No Yes Yes 4-3. Morris Cummings Ferrera Cussen Leary Meier Fauson Motion carried 6-1.
