Councilman Leary AUTHORIZATION TO SIGN AQUARIUS CONTRACT ACCEPTANCE OF THE CITY ATTORNEY'S REPORT CITY ADMINISTRATOR'S REPORT REX WALKER - WATER PURCHASE AGREEMENT AUTHORIZATION FOR MAYOR AND CLERK TO SIGN CONTRACT 9/7/82 Page -9- Leary then co~nented then the City is not really entitled to 12% of the entire package up front. Rautenstraus agreed that they could not be pressed to get the entire 12% when the con- tract is signed and the first payment made. This particular agreement was initiated in 1975 and contains different language than we are using presently. Asked a procedural question - who would be the first to sign the contract? Rautenstraus advised the City would because they are making an offer to purchase the property. Councilman Cussen moved, Councilman Leary seconded that the Mayor be authorized to sign the Aquarius Agreement as amended and corrected. Roll call vote. Morris Yes Cu~ings Yes Leary Yes Ferrera No Fauson Yes Meier Yes Cussen Yes Motion carried 6-1. Councilman Fauson moved, Councilman Ferrera seconded that the City Attorney's report be accepted and placed on file. Question called for. All in fa.vor. Motion carried. Each councilmember had a copy of the agree- ment for the purchase of l5/48ths of one share of East Boulder Ditch and bne and 29/30th share of Enterprise Irrigating Ditch water from Rex 'vJalker. Administrator Wurl advised this purchase was on the list for bond money. Councilman Cu~:ings moved, Councilman Cussen seconded the Mayor and Clerk be authorized to sign the Rex Walker Water Purchase contract. Question called for. All in favor. Motion carried unanimously.
