It did not have <br />an outlet but is contained within the project <br />and does percolate. He reiterated that he <br />was unable to meet the September 1st deadline <br />for the improvements. Some homes were being <br />sold in the development but not in the order <br />they had anticipated thus the reason for the <br />delay. He commented that city staff had been <br />very cooperative with his request. Nine of <br />the 12 units in Phase I of the proposal are <br />already constructed. Sales had not met anti- <br />cipated projections due to the economy. <br />The units on Mead Court which is in phase <br />II appear to be more saleable and would en- <br />ble him to proceed faster. He expressed con- <br />cern about specifying a date because of the <br />economy and whether or not the bank would <br />agree to finance the project. Economically <br />the development must be phased with the sales. <br />Mr. Hartman favored tieing the CO's to the <br />improvements in lieu of a specific date. <br /> <br />Inquired of Mr. Hartman when he told staff <br />that he would be unable to meet the deadline <br />on the improvements. <br />Mr. Hartman replied 2 to 3 weeks ago. <br />Cummings inquired of the City Attorney what <br />council's recourse would be if the developer <br />did not meet the September 1st deadline. <br />Rautenstraus advised perhaps building permits <br />could be withheld. <br /> <br />Requested of Attorney Rautenstraus and Director <br />Rupp to continue to work with the developer <br />and finalize the agreement acceptable to both <br />parties for the next council meeting. <br /> <br />Inquired of Director Rupp when the landscaping <br />of both the common areas and the r.etention <br />pond area would be done. <br />Rupp advised in Phase III after most of the <br />all the single family units are completed <br />to the south with the exception of 5 lots. <br />(Showing on the map the location). <br />
