How do we know that 4 years from now, <br />you will say, we tried but couldn1t do it. <br />Can you put a bond to prove it. Before any new <br />planning goes on, or before anything is accepted, <br />I would like to see a commitment backed up by a <br />bond which is required by developers. <br /> <br />We would like to sit down with your engineers <br />and planners next Thursday, (8-12~82). We plan <br />to bring our engineers from Chicago to sit with <br />Wurl, Blanchard and Rupp and discuss the various <br />issues. I have made the statement that Homart <br />is of substance, and the company will live up <br />to its commitments, and I hope the City will <br />grant us the indulgence of working wth us to <br />evaluate these projects so they will benefit <br />the community. The City requires that money <br />be in escrow and a letter of credit. This has <br />already been done, Phase I and II of the sewer <br />line. I don1t know anything else to tell you <br />except that we will operate within the law, and <br />I think that is very clear. <br /> <br />The Open Space, has that land been deeded to the <br />City? <br /> <br />The land has been dedicated by virtue of the plat <br />to the City. However, we also require deeds and <br />title insurance in addition to that as extra <br />verification. We do have the property by plat <br />and we do own it. The only way it could change <br />would be an agreement between the City and the <br />developer. <br /> <br />We have drawn the deeds, we have sent them to our <br />bank in NYC for approval ,certainly the subdivision <br />agreement indicates the open spaces are to be <br />granted to the City, that is in the agreement. <br /> <br />Discussion followed between the two regarding <br />the energy and air quality reports made by <br />different consultants 3 years ago, the Governor1s <br />i n vol ve men to f r e que s t e d cons u 1 tan t s r e p 0 r t . <br /> <br />Kahan did state he still believes to this day that <br />Louisville is the right location for a regional <br />shopping center, but the xpansion of Crossroads <br />will effectively hurt the Boulder County area of <br />ever getting a regional shopping center, however, <br />he bet wrong and concedes defeat. <br /> <br />Leary said when the land is annexed, the use of <br />land is discussed in some detail, given the fact <br />there is not going to be a regional shopping <br />center, it will re:.quire that City Council, <br />
