Attorney Rautenstraus <br />read the ordinance on first reading by title <br />only and the request was for publication. <br /> <br />Councilman Cussen moved, Councilman Ferrera <br />seconded that Ordinance #762 - Water Bond <br />1982 be published. <br /> <br />Inquired if there was an assumption that the <br />existing tax assessment is adequate because <br />the revenue is coming from the tap fees. <br />Administrator Wurl advised this was a legi- <br />timate assumption"and was put into the <br />ordinance to guarantee the bond owners that <br />revenues would be available to repay the bond, <br />by virtue of this to enjoy a lower interest <br />rate. <br /> <br />Referred to page 9 of the ordinance "to assure <br />that the revenue thereby produced, together <br />with the proceeds of the general ad valorem taxes <br />and any other legally available funds," then <br />advised this gives Council the right to dimin- <br />ish the tax levy by the amount of funds that <br />are on hand. <br /> <br />Inquired why this was an emergency ordinance. <br />Mr. Krahl advised because after second read- <br />ing it provides a better time frame to close, <br />get the money and get it invested. <br />Mr. Leary felt that was not why the emergency <br />clause was put in the State Statutes; that <br />is was intended for a real emergency, i.e. <br />a natural disaster. Felt that it has been <br />abused in the past as a means of cutting out <br />time periods available for initiative refer- <br />endum, etc. If this practice could be avoided <br />he would rather see it done. <br />
