Bo~lde~ Co~n~ CleH~ CO ORO R <br /> <br />ORDINANCE NO. 1303 <br />SERIES 1999 <br /> <br />AN ORDINANCE AUTHORIZING THE SALE AND CONVEYANCE OF A HFTY <br />PERCENT UNDIVIDED FEE INTEREST IN A 33-ACRE TRACT OF LAND OWNED BY <br />THE CITY OF LOUISVILLE AND KNOWN AS THE ADMOR WEST PARCEL, AND <br />AUTHORIZING THE EXCHANGE OF RECIPROCAL CONSERVATION EASEMENTS <br />OVER SUCH PARCEL <br /> <br /> WHEREAS, the City of Louisville is the owner of certain real property consisting of <br />33.738 acres located adjacent to Dillon Road approximately one-third of a mile west of the <br />intersection of Dillon Road and South 96th Street, which property is referred to as the "Admor <br />West Parcel" and is more particularly described in Exhibit A attached hereto and incorporated <br />herein by reference; and <br /> <br /> WHEREAS, at the time it purchased the Admor West Parcel, the City had no intent to <br />acquire, use or hold the Admor West Parcel for any park, recreation, open space or any other <br />governmental purpose within the meaning of C.R.S. section 31 - 15-713(1)(a); and <br /> <br /> WHEREAS, pursuant to the February 18, 1999, Intergovernmental Agreement, Southeast <br />Boulder County, South 96th Street, Dillon Road and U.S. 287 Area Comprehensive Development <br />Plan (the "Northwest Parkway IGA"), the Admor West Parcel has since been designated as a "City <br />Preservation Area" for residential use with a density of no more than one unit per five acres; and <br /> <br /> WHEREAS, an intergovernmental agreement CIGA") has been proposed between the City <br />of Louisville and the County of Boulder under which the County would purchase from the City a <br />fifty percent undivided fee interest in the Admor West Parcel, including a fifty percent interest in <br />the development rights for the Admor West Parcel as permitted under the Northwest Parkway IGA, <br />for a purchase price of three hundred and seventy-five thousand dollars ($375,000.00); and <br /> <br /> WHEREAS, under such IGA, the Admor West Parcel would be held and used jointly by <br />the City and County as open space, and the City and County would grant reciprocal conservation <br />easements over the Admor West Parcel pursuant to C.R.S. section 38-30.5-101 et seq., for the <br />purposes of preserving and protecting for scenic, open space, agricultural, passive recreational and <br />environmental uses, the natural condition and aesthetic and ecological features of the Admor West <br />Parcel; and <br /> <br /> WHEREAS, pursuant to C.R.S. section 31-15-713, the City Council desires to sell and <br />convey to the County a fifty percent undivided fee interest in the Admor West Parcel, and to <br />exchange reciprocal conservation easements over the Admor West Parcel; and <br /> <br /> WHEREAS, the City Council has determined it is in the best interest of the City and its <br />citizens to sell and convey to the County such fifty percent undivided fee interest in the Admor <br /> <br />1955139 <br />Page: 1 of 4 <br /> <br /> O ~.~ <br /> <br />1 <br /> <br /> <br />
