11/17/81 Page -4- Councilman Meier Remarked he tended to agree with Council- man Cummings with the exception that if a limited number of 20 was included in the ordinance; used Cottonwood Park as an example, there might be 5 separate functions totaling 100 people. Therefore it was his opinion that the exclusive park permit would be sufficient. He also remarked if the parties using the parks cleaned them up, the fee would be returned. Question on the motion. 3 Ayes - 1 Nay Councilman Cummings dissenting. Motion carried 3-1. RESOLUTION #27 - STORAGE TECHNOLOGY CORP. PUD AMEND- MENT Attorney Rautenstraus read the resolution in its entirety and each member of council had a copy before him. ADOPTION Councilman DelPizzo moved that Resolution #27 - Storage Technology Corp. P.U.D. Amendment be adopted. Seconded by Councilman Cummings. Councilman Meier Was of the op1n10n the 110' radio trans- mission tower should be lighted. Director Rupp stated the tower would not be lighted and showed council pictures of it that had been provided by Jim Graham of STC. Councilman Cummings Inquired if the law required that the tower be lighted. Director Rupp advised no if it were over 120' it would have to be lighted. Question called for on the motion. All in favor. Hotion carried 4-0. RESOLUTION #28 - TETON ENGERGY CO. - SPECIAL USE REVIEW Tabled. RESOLUTION #29 - FINAL PLAT AND P.U.D. HERITAGE SUBDIVISION Tabled. ACCEPTANCE OF THE REPORT CITY ATTORNEY'S Councilman Fauson moved that the City Attorney's Report be accepted and placed on file. Seconded by Councilman DelPizzo. Question called for. All in favor. Motion carried.
