<br />Councilman Meier <br /> <br />Councilman Fauson <br /> <br />APPROVAL <br /> <br />WATER AGREEMENT <br /> <br />AUDIENCE COMMENTS <br /> <br />CITY ATTORNEY'S REPORT <br />ORDINANCE #738 - DUTCH <br />CREEK ANNEXATION, PHASE I, <br />2ND READING, PUBLIC HEARING <br /> <br />11/5/81 <br /> <br />Page -3- <br /> <br />Remarked. it was his opinion that #12 <br />question. on the application "Will the pro- <br />posed change, likely result in a change <br />in consumption of beer or alcoholic <br />beverages on or from the licensed premises?" <br />may not be answered correctly with a no <br />by the applic.ant. <br />Attorney Rautenstraus stated it was his <br />opinion the applicant felt he would not have <br />more tables on the premises than is being <br />utilized at the present time and therefore <br />the "no" reply was permissible by applicant. <br /> <br />Advised Council that he wished to abstain <br />from voting on this particular application <br />because he has the building next door and <br />his alterations will affect his building. <br />Further he had not contacted Councilman <br />Fauson on his plans - this was his reason <br />for abstaining. Also, it was his under- <br />standing that a fire wall needed to be <br />constructed between the two buildings on <br />the south side which would involve his <br />structure. <br /> <br />Councilman Domenico moved that the Black <br />Diamond Saloon's alteration request be <br />approved. Seconded by Councilman Brown. <br />Roll call vote: <br />Fauson Abstained <br />DelPizzo Yes <br />Meier Yes <br />Brown Yes <br />Domenico Yes <br />Motion carried 4-0. <br /> <br />Tabled. <br /> <br />None <br /> <br />Attorney Rautenstraus read the ordinance <br />by title and certified proper publication. <br />Mayor Caranci opened the public hearing. <br />Director Rupp advised this involved an <br />83 acre parcel, located north of Coal Creek <br />and lies between Coal Creek and generally <br />the Bella Vista subdivision. The request <br />is for R-L zoning, single family dwellings; <br />at some future date the water and sewer <br />utilities would be coming from the north <br />
