ORDINANCE NO. 1299 <br /> SERIES 1999 <br /> <br />AN ORDINANCE AUTHORIZING AND RELATING TO THE PAYMENT OF MONEYS <br />FOR THE ACQUISITION OF FEE TITLE INTERESTS IN AND CONSERVATION <br />EASEMENTS OVER CERTAIN VACANT PARCELS OF REAL ESTATE, TOGETHER <br />WITH WATER RIGHTS, FOR OPEN SPACE, CONSERVATION AND RIGHT-OF-WAY <br />PURPOSES <br /> <br /> WHEREAS, the City of Louisville ("City") and the County of Boulder ("County") intend to <br />enter into an Intergovernmental Agreement CIGA") for the purchase and sale of fee title interests in <br />and conservation easements over certain parcels of real estate, together with water rights, totaling <br />approximately 290 acres, depicted on Exhibit A and described in Exhibit B, and generally located at <br />the northeast and southwest comers of the intersection of Dillon Road and South 104th Street, for <br />the purposes of open space and conservation, and potential right-of-way (the "Parkway Open Space <br />Parcels"); and <br /> <br /> WHEREAS, under such IGA, the City and County intend that the City will purchase fee <br />title interests in and conservation easements over the Parkway Open Space Parcels over a period of <br />three years, subject to annual appropriation by the City of funds for such purpose; and <br /> <br /> WHEREAS, under such IGA, the County shall in 1999 convey to the City fee title to Parcel <br />1 of Parkway Open Space Parcels, which Parcel 1 is approximately 46 acres, as depicted on Exhibit <br />A and described in Exhibit C, and each party shall convey to the other a conservation easement over <br />its respective fee interests; and <br /> <br /> WHEREAS, under such IGA, the County shall in 2000 and 2001 convey to the City fee <br />title to Parcels 2 and 3 of Parkway Open Space Parcels, which Parcels 2 and 3 total approximately <br />40 acres, as depicted on Exhibit A and described, respectively, in Exhibits D and E; and <br /> <br /> WHEREAS, under such IGA, the City and County shall convey fee title interests and <br />conservation easements as necessary to provide the City and County each with an undivided fee <br />interest in and a conservation easement over the entire 290 acres of Northwest Parkway Open Space <br />Parcels, as depicted on Exhibit A and described on Exhibit B; and <br /> <br /> WHEREAS, under such IGA, the City shall pay a total purchase price not to exceed three <br />million seven hundred and fifty-three thousand six hundred and seventy-three dollars and fifty cents <br />($3,753,673.50) for the Parkway Open Space Parcels, with payment for Parcel 1, to be conveyed to <br />the City in 1999, not to exceed two million dollars ($2,000,000), and payments for Parcels 2 and 3, <br />to be conveyed to the City in 2000 and 2001, not to exceed eight hundred and seventy~six thousand <br />eight hundred and thirty-six dollars and seventy-five cents ($876,836.75) in each year for the years <br />2000 and 2001; and <br /> <br /> <br />
