proceeds obtained by the entity or entities financing the Northwest Parkway, as provided in the <br />February 19, 1999, Northwest Parkway Intergovernmental Agreement among the City, County, <br />City of Broomfield and City of Lafayette. <br /> <br /> Section 4. Unless other funds become available for use by the City as determined by <br />the City Council, moneys from the Conservation Trust-Land Acquisition Fund of the City may be <br />used to pay during 1999 the one hundred and twenty-six thousand dollar ($126,000.00) purchase <br />price for the Scriffiny Conservation Easement, which is over that certain property depicted and <br />described in Exhibit F, attached hereto and incorporated herein by reference. <br /> <br /> Section 5. Nothing in this Ordinance is intended to nor should be construed to create <br />any multiple-fiscal year direct or indirect City debt or fiscal obligation whatsoever. The City <br />Council hereby further states its intent that any IGA for purchase of the Parkway Open Space Parcel <br />shall include a provision stating that any of City's obligation to make payments thereunder shall be <br />from year to year only, and payments thereunder shall be subject to annual appropriation in the sole <br />and absolute discretion of the City Council of the City, subject only to the requirement that the first <br />priority for any open space funds appropriated in 2000 and 2001 be purchase of Parkway Open <br />Space Parcels 2 and 3. <br /> <br /> Section 6. City payment for the Parkway Open Space Parcels and the Scriffiny <br />Conservation Easement shall be made in cash, certified funds or City warrant, subject to the IGA <br />and to any necessary budgetary transfers or supplementary budgets and appropriations in <br />accordance with State law. <br /> <br /> Section 7. If any portion of this ordinance is held to be invalid for any reason, such <br />decision shall not affect the validity of the remaining portions of this ordinance. The City Council <br />hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact <br />that any one part be declared invalid. <br /> <br /> Section 8.
