Staff can consult with the city <br />attorney on whether that is appropriate. <br />Brauneis proposes that staff come back to the commissions with the revised draft <br />language. <br />Hoefner moves and Diehl seconds a motion to have staff revise this current resolution <br />to be one of denial that reflect the points the commissioners made during their <br />discussion, and have the new resolution be presented at the next meeting. Final Plat, Planned Unit Development, and Special Review Use: Consideration of <br />a Final Plat, a Planned Unit Development Amendment, and a Special Review Use for <br />Lots 1 through 9 of Block 1 of the Delo Lofts Subdivision. The Delo West PUD, <br />proposes amending the Delo Lofts PUD to allow for the construction of two 33-unit <br />market rate apartment buildings and a 1,575 square foot commercial structure near the <br />corner of Cannon St. and Griffith St. <br />Applicant: Oz Architecture <br />Case Planner: Lisa Ritchie, Fire Recovery and Planning Manager <br />All notice was met as required and there is no commissioner conflict of interest. <br />Staff Presentation: <br />Ritchie begins by reviewing the background of the application. It is located within the <br />Highway 42 Revitalization Area, which was adopted in 2003, and designated for <br />residential, mixed -use development. The City adopted the Mixed Use Zone District and <br />Mixed Use Development Design Standards and Guidelines (MUDDSG) in 2007. The <br />property was re -zoned to MU-R in 2015, and the PUD, plat, and SRU was approved in <br />2016. There was a one year PUD extension approved in 2020. There was no <br />development under the previous proposal. <br />The applicant's proposal is to have two, 33 unit multi -family structures and a 1,575 sq ft <br />commercial building. She reviewed the off and on street parking spaces. 82 off-street <br />parking spaces will be provided, as 82 are required. 23 on -street parking spaces, with <br />eight required guest spaces. There will be 105 spaces total, where 92 are required (on <br />and off-street). <br />IV <br />
