City Council <br />Meeting Minutes <br />February 15, 2022 <br />Page 9of13 <br />shall a CO be issued for any residential dwelling units unless the associate commercial <br />development has received a cert of completion or similar approval for a core and shell <br />condition as would be required by the city. <br />Mayor Stolzmann asked the following questions: <br />• How would the affordable housing component be impacted by this? Will they be <br />required to pay the fee up front or with concurrency requirement? <br />• Is there anything in place to ensure that public improvements be done at the onset <br />of the project and not be delayed with the concurrency requirements? <br />• Is there anything that can be done to make sure the public improvements are done <br />prior selling any of the development? <br />Planner Ritchie provided the following answers: <br />• If the developer comes to PUD with everything ready at once then the fee would be <br />due all at once. <br />• There is nothing that would delay requirements during the PUD. <br />• Public infrastructure is to be built with the first phase. Council can require that <br />public improvements be done upfront at the time of the subdivision agreement. <br />• Staff will have a guarantee in place so that if the development stalls out the City <br />has the funds in place to finish the public improvements. It is Planning's intention to <br />garner public improvement fees up front, which is a different process than in the <br />past. <br />Councilmember Fahey asked at what point the inclusionary and senior housing units have <br />to be included. Planner Ritchie stated those details are working through at plat or PUD. <br />12% of the units would be inclusionary housing. Council could add a condition that all of <br />those come in at phase one. <br />Councilmember Brown asked if the only changes since the October hearing are the <br />potential for additional commercial and 12 units of senior housing. Planner Ritchie <br />responded that the comment was accurate. <br />Councilmember Most expressed concerns about the 5000 square feet that isn't <br />concurrent and seven large spaces in the retail portion of the development. Planner <br />Ritchie responded that the plans included in the presentation are very conceptual. <br />Applicant Brian Bair stated they have done a fairly substantial analysis of retail within a <br />mile and a half of the proposed project and there is high vacancy across all sectors. <br />Councilmember Dickinson remarked that everyone wants to know what the developer is <br />planning, but we are at a high level stage now. He acknowledged that the community and <br />Council are asking questions that aren't required of the applicant at this stage. <br />
