<br />REMARKS <br /> <br />AUDIENCE COMMENTS <br /> <br />CITY ATTORNEY's REPORT <br />ORDINANCE #709 - MORMAN CHURCH <br />ANNEXATION - PUBLIC HEARING <br /> <br />COUNCILMAN CUMMINGS <br />BASEBALL FIELDS <br /> <br />ROD WILCOX <br />715 WEST LINDEN <br /> <br />1/20/81 <br /> <br />Page - 6 - <br /> <br />Motion <br /> <br />DelPizzo <br />Domenico <br />Cummings <br />Meier <br />carried 6-0. <br /> <br />- Yes <br />- Yes <br />- Yes <br />- Yes <br /> <br />None <br /> <br />Attorney Joss read the ordinance by <br />title only and certified that it had <br />been published in the Louisville Times <br />in its entirety on Dec. 17, 1980. <br />Notices of the public hearing were <br />published on Dec. 31, 1980 and on <br />January 7, 1981. <br />Mayor Caranci opened the public hear- <br />ing and asked if anyone was present <br />supporting the annexation. None. <br />He then asked if there was anyone <br />opposed to the annexation. None. <br />Staff remarks. <br />Director Rupp stated that the City has <br />a signed agreement with the Church <br />of the Latter Day Saints, i.e. right- <br />of-way improvements deeded to the City <br />for the Washington St. realignment. <br />The customary 12% land dedication was <br />discussed and negotiated with the <br />Church attorneys and staff and it was <br />our feeling that the Church not be re- <br />quired to give the 12% land dedication. <br />They will have recreational areas <br />on site, and they deeded the right-of- <br />way for the Washington St. realignment. <br /> <br />Inquired if one of the recreational <br />areas mentioned was the baseball field <br />on top of South Boulder Road. The reply <br />was yes. He then inquired if the City <br />would be able to use the baseball fields <br />to coordinate with our recreational <br />program. <br />He was ,advised that the City would not <br />use them. <br /> <br />Informed Council that he was a realtor <br />in Boulder and a Bishop representative <br />of the Church of the Latter Day Saints. <br />He is also in charge of recreational <br />activities. He explained it was their <br />policy that should the City desire to <br />use the field, they would have to get <br />permission from them in the event they <br />
