Board of Adjustment <br />Meeting Minutes <br />August 17, 2022 <br />Page 3 of 7 <br />1 Oft wide by 14ft deep size as the 1991 house, with a new 3 and a half ft wide staircase <br />on the east side with a triangular landing at the top of the deck. <br />She concludes her presentation by reviewing the six variance criteria. The following <br />indicates staff's analysis of each criteria: <br />Criteria 1 - Criterion Met <br />Staff finds the property has an unusual rear lot line that steps inwards, which <br />creates a unique "pinch point" towards the eastern side of the property. Staff <br />finds this criterion is met. <br />Criteria 2 - Criterion Met <br />This lot is the only known lot in Centennial 8 who has the inward lot orientation in <br />the rear yard. <br />Most lots in Centennial 8 have parallel or outward oriented rear lot lines. Staff <br />therefore finds the proposal meets this criterion. <br />Criteria 3 - Criterion Met <br />The applicants have proposed to rebuild their home with the same floorplan and <br />in a similar location to their original 1991 house and deck. The original deck <br />encroached about 4 ft. into the rear yard setback in 1991, so rebuilding a <br />similarly sized deck results in a rear yard encroachment. The proposed house <br />footprint cannot be moved without the structure encroaching into the front <br />setback. Staff finds this criterion is met. <br />Criteria 4 - Criterion Met <br />The original home was destroyed by the Marshall Fire, which was a hardship not <br />created by the applicant. The applicants would like to rebuild their home with the <br />same footprint, which had a deck that was approved to encroach into the rear <br />yard setback. Staff finds this criterion is met. <br />Criteria 5 - Criterion Met <br />Staff finds that the proposal would not alter the essential character of the <br />neighborhood. The previous deck was a similar size to other decks in the <br />neighborhood, and was located in a common area relative to the house. Two <br />letters of support came in for the project from adjacent neighbors as well. <br />If the rear property lines were connected at the corners to create a parallel lot <br />line, similar to the neighboring properties, the proposed deck would conform to <br />the rear yard setback. Staff therefore finds the criteria is met. <br />Criteria 6 - Criterion Met <br />• The deck is found to be the minimum size needed to accommodate outdoor <br />dining space for a typical single family home. Staff finds the proposal meets this <br />criterion. <br />
