Board of Adjustment <br />Meeting Minutes <br />August 17, 2022 <br />Page 4 of 7 <br />Staff Recommendations: <br />Staff finds that all six criteria in Municipal code Section 17.48.110 are met and <br />recommends approval with no conditions. <br />Board Questions of Staff. <br />Cooper mentions that this deck will not have a solid roof on it. If down the road they <br />wanted a roof, would they have to get a variance? <br />Hassan says it would depend if it affected the lot coverage. <br />Ritchie says staff does view open trellises different then a solid roof. A solid roof <br />structure would have to get a variance. <br />Hawksley asks if it had a trellis in the previous structure. <br />Hassan says no it did not. <br />Hawksley asks if the setback being proposed is the same setback as the original <br />structure or just approximately the same. <br />Hassan says it is approximately the same. It is about a foot further. <br />Hawksley says for the proposed structure, is it at the minimum distance from the front <br />setback of the lot? <br />Hassan says that is correct. <br />Applicant Presentation: <br />Kurt Firnhaber, 984 Arapahoe Cir <br />Firnhaber says he purchased the house in 1991. The deck itself worked well with the <br />house, coming off the kitchen and family room. The measurements from north to south <br />is about the minimum it could be. Making the deck smaller would make it pretty much <br />unusable for outdoor seating and dining. He thinks it fits the character of the <br />neighborhood since it is similar to what was existing. He is planning to add landscaping <br />as well. <br />Berger asks if he has a landscaping plan. <br />Firnhaber says he does not have on yet but it should be similar to what was before. <br />Berger asks if he can describe what it will look like. <br />Firnhaber says they previously had a large tree off the south side of the deck between <br />the deck and the property line. We had apple trees on each corner of the lot. We also <br />had a four and a half foot cedar fence but he does not believe he can have that fence <br />there any longer. <br />Ritchie mentions that staff is still reviewing fence standards for this PUD, related to <br />what they can build back. <br />Berger says when the house was originally built, did it meet all code requirements at <br />the time of construction and not require a variance? <br />Hassan says no variance request was found in our city records. <br />Firnhaber mentions that he has had a surveyor survey the property a couple months <br />ago. The house is slightly over the eastern setback. <br />Board Questions of Applicant: <br />None is heard. <br />
