<br />Minutes - page 3 <br />October 2, 1979 <br /> <br />CITY ATTORNEY REPORT <br />ORDINANCE NO. 662 <br />ADOPTION OF 1979 <br />UNIFORM BUILDING CODE <br />SECOND READING <br />PUBLIC HEARING <br /> <br />Attorney Joss reported that Ordinance No. <br />662 was published in full and the notice <br />for public hearing was advertised on <br />September 12 and September 19, 1979. <br />Ordinance No. 662 was read by Attorney Joss <br />by title only. <br />Mayor Waschak opened the public hearing. <br />There were no additional connnents. <br />Public hearing was closed. <br />Councilman Meier moved that Ordinance <br />No. 662 be adopted. Seconded by Council- <br />man DiCarlo. Roll call. DiCarlo yes, <br />Caranci yes, Berry yes, Kilker yes, Meier <br />yes, DelPizzo yes. Motion carried. <br /> <br />ORDINANCE NO. 663 <br />FAUSON ANNEXATION <br />SECOND READING <br />PUBLIC HEARING <br /> <br />Attorney Joss reported that Ordinance <br />No. 663 was pw)lished in full September <br />19, and hearing notices were published <br />on September 19, and September 26. <br />Attorney Joss read Ordinance NO. 663 on <br />second reading by title only. <br />Mayor Waschak opened the public hearing. <br />Herman Fauson spoke in favor of the annex- <br />ation. <br />There were no other connnents. <br />Public hearing was closed. <br />Councilman Caranci asked who scheduled the <br />public hearings for this annexation and <br />zoning, because in the past the annexation <br />and zoning ordinance hearings have always <br />been on the same meeting night. <br />Councilman Caranci asked Attorney Joss if <br />he consulted the City administration before <br />doing the public hearing scheduling. <br />Attorney Joss reported that he did contact <br />Mr. Wur 1. <br />Mr. Wurl responded that he did contact him <br />to the degree that he instructed me that <br />this would appear on the agenda. <br /> <br />Attorney Joss noted that there is a 15 day <br />requirement on posting notice for zoning <br />and when the applicant wanted to run for <br />Council and wanted to have the annexation <br />completed before the election, and since <br />there is no time limit requirement for <br />annexation of property petitioned by 100% <br />of the land owners, he felt that there <br />would not be any problems with the change <br />in procedure. <br /> <br />After discussion Councilman Caranci moved <br />that Ordinance No. 663 be adopted. Se- <br />conded by Councilman DiCarlo. Roll call. <br />
