REGULAR MEETING LOUISVILLE CITY COUNCIL APRIL 3, 1979 Mayor Waschak called the meeting to order at 7:30 P.M. with the following Councilman present: DiCarlo, Berry, Meier, Caranci, and DelPizzo. Excused absence: Councilman Kilker. Others present: City Administrator Wurl, City Attorney Joss, City Planner Drumm, Parks & Rec. Direc. Stahl, ACCEPTANCE OF MINUTES Mayor Waschak and Council approved the minutes of the March 20, 1979 meeting as presented. ENCLOSURERS Councilman Berry moved that enclosurers be accepted and brought up under the pro- per head of business. Seconded by Coun- cilman Meier. Motion carried. COUNCIL ITEMS DIAMOND CONSTRUCTION PAY EST. #1 Councilman Caranci moved that pay estimate #1 in the amount of $34,526.25 be approved for Diamond Construction. Seconded by Councilman Meier. Motion carried. POWDER HORN CONSTRUCTION PAY EST. #2 Councilman Meier moved that pay estimate #2 in the amount of $104,973.30 be approved for Powder Horn Construction. Seconded by Councilman DiCarlo. Motion carried. TAYLOR EXCAVATING PAY EST. 113 Councilman DiCarlo moved that Taylor Con- struction Co. be paid the amount of $10,021.09. Seconded by Councilman Meier. Motion carried. AMERICAN PIPELINE PAY EST. 113 Councilman Meier moved that American Pipe- line pay est. #3 be paid in the amount of $22,960.08. Seconded by Councilman DiCarlo. Motion carried. COUNCIL ITEMS INITIATIVE PETITIONS Mayor Waschak allowed the proponents and opponents of the Initiative Petition speak. AGAINST Mr. Joe French, representing the Hanover Development Co. spoke against the petition stating that after reviewing the petition and from a legal point of view he did not feel that the petition was submitted at the appropriate time. He stated that the legal act of annexation has been completed and the legal way to deannex must be submitted through the property owners, which has not been done.
