Minutes - page 2 April 3, 1979 INITIATIVE PETITION CONTINUED Mr. French stated that he did not feel the petition was lawful, it was inappropriate and in law could not be granted. Mr. Les Eller, representing Bill Suitts, stated that they did not feel the petition for initiative was valid and concurred with Mr. French's conclusions. There were no other comments. Councilman Caranci moved that the Petition for Initiative be denied. Seconded by Councilman DelPizzo. Roll call. Berry yes, Caranci yes, DiCarlo yes, DelPizzo yes, Meier yes. Motion carried. POSS ANNEXATION REQUEST Councilman DiCarlo stated that due to the heavy load now on Planning Commission, he moved that all action on the Poss Annex- ation request referring the matter to the Planning Commission be deferred until the first Council meeting in June. Seconded by Councilman Caranci. Motion carried. KENNETH HIGHFILL ANNEXATION REQUEST 10.0 ACRES Mr. Midyette stated that the matter had been brought to staff earlier and at staff's request the matter was tabled, therefore they were requesting that action be taken as soon as possible. Councilman DiCarlo stated that since this was had been tabled at staff's request earlier he moved that the matter be pre- sented to the Planning Commission for their review at their first meeting of May. Seconded by Councilman Berry. Motion carried. JOSEPH GOLD ANNEXATION REQUEST 9.9 ACRES Councilman DiCarlo moved that the Dupler Annexation request be submitted to Planning Commission the first meeting of May. Seconded by Councilman Meier. Motion carried. MARCUS CHURCH HOWARD DITCH WATER Councilman Berry moved that the Mayors and City Clerks signature be authorized on the Church contract for the purchase of Howard Ditch Share. Seconded by Councilman DiCarlo. Roll call. Berry yes, Caranci yes, DiCarlo yes, DelPizzo yes, Meier yes. Motion carried.
