<br />ORDINANCE NO. 637 & 638 <br />PUBLIC HEARING <br /> <br />STAFF REMARKS <br /> <br />Minutes - page 10 <br />March 20, 1979 <br /> <br />as a regional shopping center and ancilliary <br />commercial site and amends one of the <br />sections in the comp plan to provide for <br />this use and further amend other sections <br />to provide for. <br />The proposed amendment was submitted to <br />the Boulder County Planning Comtnission <br />and the proposed amendment was defeated. <br /> <br />Following the County meeting a hearing <br />was held before the Boulder County Com- <br />missioners at which time the Commissioners <br />decided to take no legal action against <br />what the City of Louisville could do. <br /> <br />The State Land Use Commission decided not <br />only to take no action, but actually <br />stated that Louisville is in compliance <br />with all the procedures and criteria that <br />the City established several years ago <br />in response to their request and demand. <br /> <br />Based on all the information Mr. Drumm <br />recommended to Council that the annexation <br />and zoning be approved. <br /> <br />Mr. Wurl, pointed out that no consideration <br />was given to an emergency clause in the <br />ordinance until the City of Boulder threatened <br />the City of Louisville with acquisition of <br />the property and or condemnation. <br />He stated that it is his understanding that <br />in the Colorado Daily, Councilman Danish <br />renewed his request of the Boulder City <br />Council to consider possible condemnation <br />of the land, on this day, so that threat <br />never did go away. <br />Mr. Wurl reviewed the items of the emergency <br />clause. <br />Item 1. Deals with water rights and storage <br />facilities in quantities exceeding the <br />amount the City would normally obtain with <br />the annexation. <br /> <br />Staff felt that it was extremely important <br />to the City that the Council consider that <br />added water. It is important water, it's <br />early Howard water. Staff feels it important <br />for the City, as a part of the package. <br /> <br />Item 2. Open space dedication, urban shaping <br />and buffering in amounts of land that far <br />exceed the City's recommended or required <br />amount. The City requires 12% of the land <br />
